SubmittingtothequalifiedvotersofMissourianamendmentrepealingSections29,30(a),30
(b),30(c),31,and32ofArticleIVoftheConstitutionofMissouri,andadoptingseven
newsectionsinlieuthereofrelatingtothedepartmentoftransportation.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2026,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIVoftheConstitutionofthestate
5ofMissouri:
SectionA.Sections29,30(a),30(b),30(c),31,and32,ArticleIV,Constitutionof
2Missouri,arerepealedandsevennewsectionsadoptedinlieuthereof,tobeknownas
3Sections29,29(b),30(a),30(b),30(c),31,and32,toreadasfollows:
Section29.[Thehighwaysandtransportationcommissionshallbeinchargeofthe
2departmentoftransportation] Thedirectorofthedepartmentoftransportationshallbe
3appointedbythegovernorbyandwiththeadviceandconsentofthesenate,andshallbe
4inchargeofthedepartmentoftransportation.Thequalificationsofthedirectorshall
5befixedbylaw.Thegovernorshallalsoappointachiefengineerbyandwiththeadvice
6andconsentofthesenate.Thequalificationsofthechiefengineershallbefixedbylaw.
7Thehighwaysandtransportationcommissionshalladvisethegovernorregarding
8transportationmattersandthedepartmentoftransportation. Thenumber,

13(i)shallhaveauthorityoverthestatehighwaysystem;(ii)shallhaveauthorityoverallother
14transportationprogramsandfacilitiesasprovidedbylaw,including,butnotlimitedto,
15aviation,railroads,masstransportation,ports,andwaterbornecommerce;and(iii)shallhave
16authoritytolimitaccessto,fromandacrossstatehighwaysandothertransportationfacilities
17wherethepublicinterestsandsafetymayrequire.Allreferencestothehighwaycommission
18andthedepartmentofhighwaysinthisconstitutionandinthestatutesshallmeanthe
19highwaysandtransportationcommissionandthedepartmentoftransportation.]
Section29(b).Thedepartmentoftransportation(i)shallhaveauthorityoverthe
2statehighwaysystem;(ii)shallhaveauthorityoverallothertransportationprograms
3andfacilitiesasprovidedbylawincluding,butnotlimitedto,aviation,railroads,mass
4transportation,ports,andwaterbornecommerce;and(iii)shallhaveauthoritytolimit
5accessto,fromandacrossstatehighwaysandothertransportationfacilitieswherethe
6publicinterestsandsafetymayrequire.Allreferencestothehighwaycommissionand
7thedepartmentofhighwaysinthisconstitutionandinthestatutesshallmeanthe
8departmentoftransportation.
Section30(a).1.Ataxuponormeasuredbyfuelusedforpropellinghighwaymotor
2vehiclesshallbeleviedandcollectedasprovidedbylaw.Anyamountofthetaxcollected
3withrespecttofuelnotusedforpropellinghighwaymotorvehiclesshallberefundedbythe
4stateinthemannerprovidedbylaw.Theremainingnetproceedsofthetax,afterdeducting
5actualcostsofcollectionofthedepartmentofrevenue(butafterJune30,2005,notmorethan
6threepercentoftheamountcollected)andrefundsforoverpaymentsanderroneouspayments
7ofsuchtaxaspermittedbylaw,shallbeapportionedanddistributedbetweenthecounties,
8citiesandthe[statehighwaysandtransportationcommission] departmentoftransportation
9ashereinafterprovidedandshallstandappropriatedwithoutlegislativeactionforthe
10followingpurposes:
11 (1)Tenpercentoftheremainingnetproceedsshallbedepositedinaspecialtrustfund
12knownasthe"CountyAidRoadTrustFund".Inaddition,beginningJuly1,1994,an
13additionalfivepercentoftheremainingnetproceedswhichisderivedfromthedifference
14betweentheamountreceivedfromataxrateequaltothetaxrateineffectonMarch31,1992,
15andthetaxrateineffectonandafterJuly1,1994,shallalsobedepositedinthecountyaid
16roadtrustfund,andofsuchmoneysgeneratedbythisadditionalfivepercent,fivepercent
17shallbeapportionedanddistributedsolelytocitiesnotwithinanycountyinthisstate.After
18suchdistributiontocitiesnotwithinanycounty,theremainingproceedsinthecountyaid
HJR32 2 19roadtrustfundshallbeapportionedanddistributedtothevariouscountiesofthestateonthe
20followingbasis:One-halfontheratiothatthecountyroadmileageofeachcountybearstothe
21countyroadmileageoftheentirestateasdeterminedbythelastavailablereportofthe[state
22highwaysandtransportationcommission] departmentoftransportationandone-halfonthe
23ratiothattherurallandvaluationofeachcountybearstotherurallandvaluationoftheentire
24stateasdeterminedbythelastavailablereportofthestatetaxcommission,exceptthatcounty
25roadmileageinincorporatedvillages,townsorcitiesandthelandvaluationinincorporated
26villages,townsorcitiesshallbeexcludedinsuchdetermination,exceptthat,iftheassessed
27valuationofrurallandsinanycountyislessthanfivemilliondollars,thecountyshallbe
28treatedashavinganassessedvaluationoffivemilliondollars.Thefundsapportionedand
29distributedtoeachcountyshallbededicated,usedandexpendedbythecountysolelyforthe
30construction,reconstruction,maintenanceandrepairsofroads,bridgesandhighways,and
31subjecttosuchotherprovisionsandrestrictionsasprovidedbylaw.Themoneysgenerated
32bytheadditionalfivepercentoftheremainingnetproceedswhichisderivedfromthe
33differencebetweentheamountreceivedfromataxrateequaltothetaxrateineffecton
34March31,1992,andthetaxrateineffectonandafterJuly1,1994,shallnotbeusedor
35expendedforequipment,machinery,salaries,fringebenefitsorcapitalimprovements,other
36thanroadsandbridges.Incountieshavingthetownshipformofcountyorganization,the
37fundsdistributedtosuchcountiesshallbeexpendedsolelyunderthecontrolandsupervision
38ofthecountycommission,andshallnotbeexpendedbythevarioustownshipslocatedwithin
39suchcounties."Ruralland"asusedinthissectionshallmeanalllandlocatedwithinany
40county,exceptlandinincorporatedvillages,towns,orcities.
41 (2)Fifteenpercentoftheremainingnetproceedsshallbeapportionedanddistributed
42tothevariousincorporatedcities,townsandvillageswithinthestatesolelyforconstruction,
43reconstruction,maintenance,repair,policing,signing,lightingandcleaningroadsandstreets
44andforthepaymentofprincipalandinterestonindebtednessonaccountofroadandstreet
45purposes,andtheusethereofbeingsubjecttosuchotherprovisionsandrestrictionsas
46providedbylaw.Theamountapportionedanddistributedtoeachcity,townorvillageshall
47bebasedontheratiothatthepopulationofthecity,townorvillagebearstothepopulationof
48allincorporatedcities,townsorvillagesinthestatehavingalikepopulation,asshownbythe
49lastfederaldecennialcensus,providedthatanycity,townorvillagewhichhadamotorfuel
50taxpriortotheadoptionofthissectionshallannuallyreceivenotlessthananamountequalto
51thenetrevenuederivedtherefromintheyear1960;and
52 (3)Alltheremainingnetproceedsinexcessofthedistributionstocounties,andto
53cities,townsandvillagesunderthissectionshallbeapportioned,distributedanddepositedin
54thestateroadfundandshallbeexpendedandusedsolelyasprovidedinsubsection1of
55section30(b)ofArticleIVofthisConstitution.
HJR32 3 56 2.Thedirectorofrevenueofthestateshallmaketheapportionment,distributionand
57depositofthefundsmonthlyinthemannerrequiredhereby.
58 3.Exceptfortaxesorlicenseswhichmaybeimposeduniformlyonallmerchantsor
59manufacturersbaseduponsales,orwhichuniformlyapplyadvaloremtothestocksof
60merchantsormanufacturers,nopoliticalsubdivisioninthisstateshallcollectanytax,excise,
61licenseorfeeupon,measuredbyorwithrespecttotheimportation,receipt,manufacture,
62storage,transportation,saleoruse,onorafterthefirstdayofthemonthnextfollowingthe
63adoptionofthissectionoffuelusedforpropellingmotorvehicles,unlessthetax,excise,
64licenseorfeeisapprovedbyavoteofthepeopleofanycity,townorvillagesubsequenttothe
65adoptionofthissection,byatwo-thirdsmajority.Allfundscollectedshallbeusedsolelyfor
66construction,reconstruction,maintenance,repair,policing,signing,lighting,andcleaning
67roadsandstreetsandforthepaymentandinterestonindebtednessincurredonaccountof
68roadandstreetpurposes.
69 4.Thenetproceedsoffueltaxesapportioned,distributedanddepositedunderthis
70sectiontothestateroadfund,counties,cities,townsandvillagesshallnotbeincludedwithin
71thedefinitionof"totalstaterevenues"insection17ofarticleXofthisconstitutionnorbe
72consideredasan"expenseofstategovernment"asthattermisusedinsection20ofarticleX
73ofthisconstitution.
Section30(b).1.Forthepurposeofconstructingandmaintaininganadequatesystem
2ofconnectedstatehighwaysallstaterevenuederivedfromhighwayusersasanincidentto
3theiruseorrighttousethehighwaysofthestate,includingallstatelicensefeesandtaxes
4uponmotorvehicles,trailersandmotorvehiclefuels,andupon,withrespectto,oronthe
5privilegeofthemanufacture,receipt,storage,distribution,saleorusethereof(excepting
6thoseportionsofthesalestaxonmotorvehiclesandtrailerswhicharenotdistributedtothe
7stateroadfundpursuanttosubsection2ofthissection30(b)andfurtherexceptingall
8propertytaxes),lessthe(1)actualcostofcollectionofthedepartmentofrevenue(butnotto
9exceedthreepercentoftheparticulartaxorfeecollected),(2)actualcostofrefundsfor
10overpaymentsanderroneouspaymentsofsuchtaxesandfeesandmaintainingretirement
11programsaspermittedbylawand(3)actualcostofthestatehighwaypatrolinadministering
12andenforcinganystatemotorvehiclelawsandtrafficregulations,shallbedepositedinthe
13stateroadfundwhichisherebycreatedwithinthestatetreasuryandstandappropriated
14withoutlegislativeactiontobeusedandexpendedbythe[highwaysandtransportation
15commission] departmentoftransportationforthefollowingpurposes,andnoother:
16 First,tothepaymentoftheprincipalandinterestonanyoutstandingstateroadbonds.
17Thetermstateroadbondsinthissection30(b)meansanybondsorrefundingbondsissuedby
18the[highwaysandtransportationcommission] departmentoftransportationtofinanceor
19refinancetheconstructionorreconstructionofthestatehighwaysystem.
HJR32 4 20 Second,tomaintainabalanceinthestateroadfundintheamountdeemednecessary
21tomeetthepaymentoftheprincipalandinterestofanystateroadbondsforthenext
22succeedingtwelvemonths.
23 Theremainingbalanceinthestateroadfundshallbeusedandexpendedinthesole
24discretionofandunderthesupervisionanddirectionofthe[highwaysandtransportation
25commission] departmentoftransportationforthefollowingstatehighwaysystemusesand
26purposesandnoother:
27 (1)Tocompleteandwidenorotherwiseimproveandmaintainthestatehighway
28systemheretoforedesignatedandlaidoutunderexistinglaws;
29 (2)Toreimbursethevariouscountiesandotherpoliticalsubdivisionsofthestate,
30exceptincorporatedcitiesandtowns,formoneyexpendedbythemintheconstructionor
31acquisitionofroadsandbridgesnoworhereaftertakenoverbythe[highwaysand
32transportationcommission] departmentoftransportationaspermanentpartsofthestate
33highwaysystem,totheextentofthevaluetothestateofsuchroadsandbridgesatthetime
34takenover,notexceedinginanycasetheamountexpendedbysuchcountiesandsubdivisions
35intheconstructionoracquisitionofsuchroadsandbridges,exceptthatthe[highwaysand
36transportationcommission] departmentmay,initsdiscretion,repay,oragreetorepay,any
37cashadvancedbyacountyorsubdivisiontoexpeditestateroadconstructionorimprovement;
38 (3)Inthediscretionofthe[commission] departmenttoplan,locate,relocate,
39establish,acquire,constructandmaintainthefollowing:
40 (a)interstateandprimaryhighwayswithinthestate;
41 (b)supplementarystatehighwaysandbridgesineachcountyofthestate;
42 (c)statehighwaysandbridgesin,toandthroughstateparks,publicareasand
43reservations,andstateinstitutionsnoworhereafterestablishedtoconnectthesamewiththe
44statehighways,andalsonational,stateorlocalparkways,travelways,tourways,with
45coordinatedfacilities;
46 (d)anytunnelorinterstatebridgeorpartthereof,wherenecessarytoconnectthestate
47highwaysofthisstatewiththoseofotherstates;
48 (e)anyhighwaywithinthestatewhennecessarytocomplywithanyfederallawor
49requirementwhichisorshallbecomeaconditiontothereceiptoffederalfunds;
50 (f)anyhighwayinanycityortownwhichisfoundnecessaryasacontinuationofany
51stateorfederalhighway,oranyconnectiontherewith,intoandthroughsuchcityortown;and
52 (g)additionalstatehighways,bridgesandtunnels,eitherincongestedtrafficareasof
53thestateorwhereneededtofacilitateandexpeditethemovementofthroughtraffic.
54 (4)Toacquirematerials,equipmentandbuildingsandtoemploysuchpersonnelas
55necessaryforthepurposesdescribedinthissubsection1;and
HJR32 5 56 (5)Forsuchotherpurposesandcontingenciesrelatingandappertainingtothe
57constructionandmaintenanceofsuchstatehighwaysystemasthe[highwaysand
58transportationcommission] departmentoftransportationmaydeemnecessaryandproper.
59 2.(1)Thestatesalestaxuponthesaleofmotorvehicles,trailers,motorcycles,
60mopedsandmotortricyclesattherateprovidedbylawonNovember2,2004,isleviedand
61imposedbythissectionuntiltherateischangedbylaworconstitutionalamendment.
62 (2)One-halfoftheproceedsfromthestatesalestaxonallmotorvehicles,trailers,
63motorcycles,mopedsandmotortricyclesshallbededicatedforhighwayandtransportation
64useandshallbeapportionedanddistributedasfollows:tenpercenttothecounties,fifteen
65percenttothecities,twopercenttobedepositedinthestatetransportationfund,whichis
66herebycreatedwithinthestatetreasurytobeusedinamannerprovidedbylawandseventy-
67threepercenttobedepositedinthestateroadfund.Theamountsapportionedanddistributed
68tothecountiesandcitiesshallbefurtherallocatedandusedasprovidedinsection30(a)of
69thisarticle.Theamountsallocatedanddistributedtothe[highwaysandtransportation
70commission] departmentoftransportationforthestateroadfundshallbeusedasprovided
71insubsection1ofthissection30(b).Thesalestaxeswhichareapportionedanddistributed
72pursuanttothissubdivision(2)shallnotincludethosetaxesleviedandimposedpursuantto
73sections43(a)or47(a)ofthisarticle.Theterm"proceedsfromthestatesalestax"asusedin
74thissubdivision(2)shallmeanandincludeallrevenuesreceivedbythedepartmentof
75revenuefromthesaidsalestax,reducedonlybyrefundsforoverpaymentsanderroneous
76paymentsofsuchtaxaspermittedbylawandactualcostsofcollectionbythedepartmentof
77revenue(butnottoexceedthreepercentoftheamountcollected).
78 (3)(i)FromandafterJuly1,2005,throughJune30,2006,twenty-fivepercentofthe
79remainingone-halfoftheproceedsofthestatesalestaxonallmotorvehicles,trailers,
80motorcycles,mopedsandmotortricycleswhichisnotdistributedbysubdivision(2)of
81subsection2ofthissection30(b)shallbedepositedinthestateroadbondfundwhichis
82herebycreatedwithinthestatetreasury;(ii)fromandafterJuly1,2006,throughJune30,
832007,fiftypercentoftheaforesaidone-halfoftheproceedsofthestatesalestaxonallmotor
84vehicles,trailers,motorcycles,mopedsandmotortricycleswhichisnotdistributedby
85subdivision(2)ofsubsection2ofthissection30(b)shallbedepositedinthestateroadbond
86fund;(iii)fromandafterJuly1,2007,throughJune30,2008,seventy-fivepercentofthe
87aforesaidone-halfoftheproceedsofthestatesalestaxonallmotorvehicles,trailers,
88motorcycles,mopedsandmotortricycleswhichisnotdistributedbysubdivision(2)of
89subsection2ofthissection30(b)shallbedepositedinthestateroadbondfund;and(iv)from
90andafterJuly1,2008,onehundredpercentoftheaforesaidone-halfoftheproceedsofthe
91statesalestaxonallmotorvehicles,trailers,motorcycles,mopedsandmotortricycleswhich
92isnotdistributedbysubdivision(2)ofsubsection2ofthissection30(b)shallbedepositedin
HJR32 6 93thestateroadbondfund.Moneysdepositedinthestateroadbondfundareherebydedicated
94toandshallonlybeusedtofundtherepaymentofbondsissuedbythe[highwaysand
95transportationcommission] departmentoftransportationtofundtheconstructionand
96reconstructionofthestatehighwaysystemortofundrefundingbonds,exceptthatafter
97January1,2009,thatportionofthemoneysinthestateroadbondfundwhichthe
98commissionerofadministrationandthe[highwaysandtransportationcommission] director
99ofthedepartmentoftransportationeachcertifyisnotneededtomakepaymentsuponsaid
100bondsortomaintainanadequatereserveformakingfuturepaymentsuponsaidbondsmaybe
101appropriatedtothestateroadfund.The[highwaysandtransportationcommission]
102departmentoftransportationshallhaveauthoritytoissuestateroadbondsfortheusesset
103forthinthissubdivision(3).Thenetproceedsreceivedfromtheissuanceofsuchbondsshall
104bepaidintothestateroadfundandshallonlybeusedtofundconstructionorreconstruction
105ofspecificprojectsforpartsofthestatehighwaysystemasdeterminedbythe[highwaysand
106transportationcommission] departmentoftransportation. Themoneysdepositedinthe
107stateroadbondfundshallonlybewithdrawnbyappropriationpursuanttothisconstitution.
108Noobligationforthepaymentofmoneyssoappropriatedshallbepaidunlessthe
109commissionerofadministrationcertifiesitforpaymentandfurthercertifiesthatthe
110expenditureisforausewhichisspecificallyauthorizedbytheprovisionsofthissubdivision
111(3).Theproceedsofthesalestaxwhicharesubjecttoallocationanddepositintothestate
112roadbondfundpursuanttothissubdivision(3)shallnotincludetheproceedsofthesalestax
113leviedandimposedpursuanttosections43(a)or47(a)ofthisarticlenorshalltheyincludethe
114proceedsofthatportionofthesalestaxapportioned,distributedanddedicatedtotheschool
115districttrustfundonNovember2,2004.Theterm"proceedsfromthestatesalestax"asused
116inthissubdivision(3)shallmeanandincludeallrevenuesreceivedbythedepartmentof
117revenuefromthesaidsalestax,reducedonlybyrefundsforoverpaymentsanderroneous
118paymentsofsuchtaxaspermittedbylawandactualcostsofcollectionbythedepartmentof
119revenue(butnottoexceedthreepercentoftheamountcollected).
120 3.AfterJanuary1,1980,anyincreaseinstatelicensefeesandtaxesonmotor
121vehicles,trailers,motorcycles,mopedsandmotortricyclesotherthanthosetaxesdistributed
122pursuanttosubsection2ofthissection30(b)shallbedistributedasfollows:tenpercenttothe
123counties,fifteenpercenttothecitiesandseventy-fivepercenttobedepositedinthestateroad
124fund.Theamountsdistributedshallbeapportionedanddistributedtothecountiesandcities
125asprovidedinsection30(a)ofthisarticle,tobeusedforhighwaypurposes.
126 4.Themoneysapportionedordistributedunderthissectiontothestateroadfund,the
127statetransportationfund,thestateroadbondfund,counties,cities,townsorvillagesshallnot
128beincludedwithinthedefinitionof"totalstaterevenues"asthattermisusedinsection17of
HJR32 7 129ArticleXofthisconstitutionnorbeconsideredasan"expenseofstategovernment"asthat
130termisusedinsection20ofarticleXofthisconstitution.
Section30(c).The[highwaysandtransportationcommission] departmentof
2transportationshallhaveauthoritytoplan,locate,relocate,establish,acquire,construct,
3maintain,control,andasprovidedbylawtooperate,developandfundpublictransportation
4facilitiesaspartofanystatetransportationsystemorprogramsuchasbutnotlimitedto
5aviation,masstransportation,transportationofelderlyandhandicapped,railroads,ports,
6waterbornecommerceandintermodalconnections,providedthatfundsotherthanthose
7designatedordedicatedforhighwaypurposesinordepositedinthestateroadfundorthe
8stateroadbondfundpursuanttosections30(a)or30(b)ofthisconstitutionaremadeavailable
9forsuchpurposes.Nomoneyswhicharedistributedtothestatetransportationfundpursuant
10tosection30(b)shallbeusedforanypurposeotherthanfortransportationpurposesas
11providedinthissection.
Section31.Anystatehighwayauthorizedhereintobelocatedinanymunicipality
2maybeconstructedwithoutlimitationsconcerningthedistancebetweenhousesorother
3buildingsabuttingsuchhighwayorconcerningthewidthortypeofconstruction.The
4[commission] departmentoftransportationmayenterintocontractswithcities,countiesor
5otherpoliticalsubdivisionsforandconcerningthemaintenanceof,andregulationoftraffic
6onanystatehighwaywithinsuchcities,countiesorsubdivision.
Section32.Thefundswhichareallottedbythe[commission] departmentof
2transportationtotheconstructionoracquisitionofsupplementarystatehighwaysand
3bridgesineachofthecountiesofthestateshallbeapportionedtotheseveralcountiesas
4follows:One-fourthintheratiothattheareaofeachcountybearstotheareaofthestate,one-
5fourthintheratioofthepopulation,andtwo-fourthsonsuchbasisasthe[commission]
6departmentoftransportationmaydeemtobeforthebestinterestofhighwayusers;
7providedtheareasandpopulationofcitieshavingapopulationof150,000ormoreshallnot
8beconsideredinmakingsuchapportionment,andthelatestavailableUnitedStatesdecennial
9censusshallbeused;providedfurther,thatiftrafficonanysupplementarystatehighway
10becomessuchthatahighertypethanordinarysupplementaryhighwayconstructionshallbe
11required,thenthe[commission] departmentoftransportationmayconstructsuchhigher
12typeandchargesuchextracosttounallottedstatehighwayfunds.Supplementarystate
13highwaysshallbeselectedbymutualagreementofthe[commission] departmentof
14transportationandthelocalofficialshavingchargeoforjurisdictionoverroadsinthe
15territorythroughwhichsuchsupplementarystatehighwaysaretobeconstructed.
