JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSection23ofArticleI
oftheConstitutionofMissouri,andadoptingonenewsectioninlieuthereofrelating
tofirearms,withpenaltyprovisions.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2026,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIoftheConstitutionofthestateof
5Missouri:
SectionA.Section23,ArticleI,ConstitutionofMissouri,isrepealedandonenew
2sectionadoptedinlieuthereof,tobeknownasSection23,toreadasfollows:
Section23.[Thattherightofeverycitizentokeepandbeararms,ammunition,and
2accessoriestypicaltothenormalfunctionofsucharms,indefenseofhishome,person,
3familyandproperty,orwhenlawfullysummonedinaidofthecivilpower,shallnotbe
4questioned.Therightsguaranteedbythissectionshallbeunalienable.Anyrestrictionon
5theserightsshallbesubjecttostrictscrutinyandthestateofMissourishallbeobligatedto
6upholdtheserightsandshallundernocircumstancesdeclinetoprotectagainsttheir
7infringement.Nothinginthissectionshallbeconstruedtopreventthegeneralassemblyfrom
8enactinggenerallawswhichlimittherightsofconvictedviolentfelonsorthoseadjudicated
9byacourttobeadangertoselforothersasresultofamentaldisorderormentalinfirmity.]
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 10IncompliancewiththeSecondAmendmentoftheConstitutionoftheUnitedStatesand
11limitedbydecisionsoftheUnitedStatesSupremeCourtandfederallaw,anycounty,the
12cityofSt.Louis,andthecityofKansasCitymay,byordinancedulyenacted,regulate
13thepossession,carrying,ortransferoffirearmswithinthelimitsofthecityorcounty
14notwithstandinganyotherprovisionoflaw,subjecttothefollowing:
15 (1)Anordinanceauthorizingtheissuanceofapermitorcertificatemayprovide
16forthecityorcountytochargeafeethatissufficienttocoverthecostsofissuing
17permitsorcertificatesbutthatdoesnotexceedthecoststherefor.Anypermitsor
18certificatesissuedinaccordancewithsuchordinanceshallnotbevalidformorethan
19fiveyears.Thecityorcountymayobtainbackgroundcheckinformationfromthe
20federalNationalInstantCriminalBackgroundCheckSystemoranyother
21governmentalagencyprovidingsuchinformationservice;
22 (2)Anyordinanceadoptedinaccordancewiththissectionmayapplyto
23nonresidentsaswellasresidentsofthecityorcountybutshallrecognizeasvalidany
24permitorcertificateauthorizingthepossessionorcarryingoffirearmsissuedbythe
25countyofresidenceofthepermitholderorcertificateholder.Anysuchordinanceshall
26alsoexemptanyactivedutyorretiredlawenforcementofficerwhoiscurrentlycertified
27ascompliantwiththepeaceofficerstandardsandtrainingrequiredinthisstate,any
28full-timejudge,andanypersonwhoisrequiredtobearmedasaconditionof
29employmentduringactiveemploymentasalicensedsecurityguardorasagovernment
30employee,includinganymemberofthemilitary;and
31 (3)Anyordinanceadoptedinaccordancewiththissectionmayprovidepenalties
32forviolation,butsuchpenaltiesshallnotexceedafineofonethousanddollarsor
33imprisonmentinthecountyjailforatermofuptooneyear,orboth.Anysuch
34ordinancemayalsoauthorizealawenforcementofficer,uponprobablecause,toseize
35anyfirearminthepossessionofapersonwhoisineligiblebylawtopossessthefirearm.
