JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmenttoArticleIoftheConstitution
ofMissouri,byadoptingonenewsectionrelatingtoreproductivehealthcare.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2026,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIoftheConstitutionofthestateof
5Missouri:
SectionA.ArticleI,ConstitutionofMissouri,isamendedbyadoptingonenew
2section,tobeknownasSection36(a),toreadasfollows:
36(a).1.NotwithstandinganyprovisionofSection36ofArticleIofthis
2Constitutiontothecontrary:
3 (1)Noabortionshallbeperformedorinduceduponawoman,exceptincasesof
4medicalemergency,fetalanomaly,rape,orincest.Inthecaseofabortionsperformedor
5inducedincasesofrapeorincest,theabortionmaybeperformedorinducednolater
6thantwelveweeksgestationalageoftheunbornchildandonlyifdocumentationis
7presentedtotheattendingphysicianthattherapeorincesthasbeenreportedtoalaw
8enforcementagencythathasjurisdictiontoinvestigatethecomplaintatleastforty-eight
9hourspriortotheabortion;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 10 (2)Noabortionshallbeperformedorinduceduponawomanbasedona
11prenataldiagnosis,test,orscreeningindicatingadisabilityinanunbornchild,exceptin
12casesoffetalanomaly;
13 (3)Nopublicfundsshallbeexpendedforthepurposeofperformingorinducing,
14orotherwiseassisting,anyabortion,exceptforabortionsperformedorinducedupona
15womanincasesofmedicalemergency,fetalanomaly,rape,orincestinaccordancewith
16subdivision(1)ofthissubsection;
17 (4)Nogendertransitionsurgeriesshallbeknowinglyperformedonchildren
18undereighteenyearsofageandnocross-sexhormonesorpuberty-blockingdrugsshall
19beknowinglyprescribedoradministeredforthepurposeofgendertransitionto
20childrenundereighteenyearsofage.Theprovisionsofthissectionshallnotapplyto
21theuseofsuchsurgeries,drugs,orhormonestotreatchildrenbornwithamedically
22verifiabledisorderofsexdevelopmentortotreatanyinfection,injury,disease,or
23disorderunrelatedtothepurposeofagendertransition;and
24 (5)Anypersonwhointentionallyornegligentlycausesdamagetoanother
25personrelatingtotheprovisionofprenatalcare,childbirth,postpartumcare,
26miscarriagecare,orfortheperformanceorinducementofanabortionshallbeliable
27fordamagesandshallbesubjecttothesuspensionorrevocationofhisorhermedical
28license.
29 2.Awoman'srighttoreproductivefreedomshallincludetherighttohealthcare
30incasesofmiscarriages,ectopicpregnancies,andothermedicalemergenciesandthe
31provisionsofthissectionshallnotbeconstruedtolimitawoman'saccesstosuchhealth
32care.
33 3.Thegeneralassemblyshallhavetheauthoritytoenactlawstocarryoutthe
34provisionsofthissection.
35 4.Asusedinthissection,thefollowingtermsmean:
36 (1)"Cross-sexhormones",testosterone,estrogen,orotherandrogensgiventoan
37individualinamountsthataregreaterormorepotentthanwouldnormallyoccur
38naturallyinahealthyindividualofthesameageandsex;
39 (2)"Fetalanomaly",astructuralorfunctionalabnormalityintheunborn
40child'sgestationaldevelopmentthatwouldmakelifeoutsidethewombimpossibleand
41thatwouldpresentaseriousphysicalrisktothemothertocarrythechildtoterm;
42 (3)"Gendertransitionsurgery",asurgicalprocedureperformedforthe
43purposeofassistinganindividualwithidentifyingwithandlivingasagenderdifferent
44fromhisorherbiologicalsex;
45 (4)"Medicalemergency",aconditionwhich,basedonreasonablemedical
46judgment,socomplicatesthemedicalconditionofapregnantwomanastonecessitate
HJR54	2 47theimmediateterminationofherpregnancytoavertthedeathofthepregnantwoman
48orforwhichadelaywillcreateaseriousriskofsubstantialandirreversiblephysical
49impairmentofamajorbodilyfunctionofthepregnantwoman.Amedicalemergency
50shallinclude,butnotbelimitedto,anectopicpregnancyatanypointfollowingthe
51diagnosisofsuch;
52 (5)"Puberty-blockingdrugs",gonadotropin-releasinghormoneanaloguesor
53othersyntheticdrugsusedtostopluteinizinghormonesecretionandfolliclestimulating
54hormonesecretion,syntheticantiandrogendrugstoblocktheandrogenreceptor,orany
55otherdrugusedtodelayorsuppresspubertaldevelopmentinchildrenforthepurpose
56ofassistinganindividualwithagendertransition.
SectionB.Pursuanttochapter116,andotherapplicableconstitutionalprovisionsand
2lawsofthisstateallowingthegeneralassemblytoadoptballotlanguageforthesubmissionof
3thisjointresolutiontothevotersofthisstate,theofficialsummarystatementofthis
4resolutionshallbeasfollows:
5 "ShalltheMissouriConstitutionbeamendedto:
6 •Preventabortionbasedonaprenataldisabilitydiagnosis;
7 •Limitabortiontocasesofmedicalemergency,fetalanomaly,rape,andincest;
8 •Protecthealthcareaccessformiscarriages,ectopicpregnancies,andmedical
9emergencies;and
10 •Prohibitsurgeries,hormones,anddrugsusedonchildrenforgendertransition
11purposes?".
