Uponvoterapproval,thisconstitutional amendmentprohibits
abortions,exceptincasesofmedicalemergencies,fetalanomalies,
rape,orincest.Inthecaseofabortionsperformedorinduced
becauseofrapeorincest,theabortionmaybeperformedorinduced
nolaterthan12weeksgestationalageoftheunbornchildandonly
ifdocumentationispresentedtotheattendingphysicianthatthe
rapeorincesthasbeenreportedtoalawenforcementagencythat
hasjurisdictiontoinvestigatethecomplaintatleast48hours
priortotheabortion.
Theamendmentalsoprohibitspublicfundsfrombeingusedtopay
forabortions;prohibitstheuseofsurgeries,hormones,ordrugs
toassistachildwithagendertransition;andholdsthatany
personwhointentionallyornegligentlycausesdamagetoanother
personrelatingtotheprovisionofreproductivehealthcareorthe
performanceorinducementofanabortionisliablefordamagesand
subjecttosuspensionorrevocationofhisorhermedicallicense.
Underthisconstitutional amendment,awoman'srightto
reproductivefreedomincludestherighttohealthcareincasesof
miscarriages,ectopicpregnancies,andothermedicalemergencies.
TheGeneralAssemblywillhavetheauthoritytoenactlawstocarry
outtheseprovisions.
