ThefollowingisasummaryoftheHouseCommitteeSubstitutefor
HJR54.
Uponvoterapproval,thisconstitutional amendmentprohibits
abortions,exceptincasesofmedicalemergencies,fetalanomalies,
rape,orincest.Inthecaseofabortionsperformedorinduced
becauseofrapeorincest,theabortionmaybeperformedorinduced
nolaterthan12weeksgestationalageoftheunbornchild.
Theamendmentalsoprohibitspublicfundsfrombeingusedtopay
forabortions;prohibitstheuseofsurgeries,hormones,ordrugs
toassistachildwithagendertransition;specifieswhichcircuit
courtchallengesshallbebroughtto;andholdsthatanypersonwho
intentionallyornegligentlycausesdamagetoanotherperson
relatingtotheprovisionofreproductivehealthcareorthe
performanceorinducementofanabortionisliablefordamagesand
subjecttosuspensionorrevocationofhisorhermedicallicense.
Underthisconstitutional amendment,awoman'srightto
reproductivefreedomincludestherighttohealthcareincasesof
miscarriages,ectopicpregnancies,andothermedicalemergencies.
TheGeneralAssemblywillhavetheauthoritytoenactlawstocarry
outtheseprovisions.

versionofthebill.
PROPONENTS: Supporterssaythatvotersdidnotknowtheentirety
ofwhattheywerevotingonasitrelatedtoAmendment3,including
thefreedomtoabortanunbornchildwithDown'sSyndromeor
becauseofthatunbornchild'sraceorsex.Theamendmentwas
passedverynarrowlyandtheprocesswasfloodedwithdarkmoney
fromout-of-statetopresentfalseinformationtovoters.Itis
breathtakingly irresponsibletoallowthefeelingsofchildrento
dictatewhetherapersoncanchangetheirgender.Medical
malpracticeisdifferentthansomeonewhowouldbreaktheirmedical
oathtoprotectunbornlife.
