JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSection30(b)of
ArticleIVoftheConstitutionofMissouri,andadoptingonenewsectioninlieu
thereofrelatingtotheappropriationofstatefunds.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2026,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIVoftheConstitutionofthestate
5ofMissouri:
SectionA.Section30(b),ArticleIV,ConstitutionofMissouri,isrepealedandone
2newsectionadoptedinlieuthereof,tobeknownasSection30(b),toreadasfollows:
Section30(b).1.Forthepurposeofconstructingandmaintaininganadequatesystem
2ofconnectedstatehighwaysallstaterevenuederivedfromhighwayusersasanincidentto
3theiruseorrighttousethehighwaysofthestate,includingallstatelicensefeesandtaxes
4uponmotorvehicles,trailersandmotorvehiclefuels,andupon,withrespectto,oronthe
5privilegeofthemanufacture,receipt,storage,distribution,saleorusethereof(excepting
6thoseportionsofthesalestaxonmotorvehiclesandtrailerswhicharenotdistributedtothe
7stateroadfundpursuanttosubsection2ofthissection30(b)andfurtherexceptingall
8propertytaxes),lessthe(1)actualcostofcollectionofthedepartmentofrevenue(butnotto
9exceedthreepercentoftheparticulartaxorfeecollected),(2)actualcostofrefundsfor

11programsaspermittedbylawand(3)actualcostofthestatehighwaypatrolinadministering
12andenforcinganystatemotorvehiclelawsandtrafficregulations,shallbedepositedinthe
13stateroadfundwhichisherebycreatedwithinthestatetreasury[andstandappropriated
14withoutlegislativeaction] tobeusedandexpendedbythehighwaysandtransportation
15commission, pursuanttoanappropriationbythegeneralassembly,forthefollowing
16purposes[,] andnoother:
17 First,tothepaymentoftheprincipalandinterestonanyoutstandingstateroadbonds.
18Thetermstateroadbondsinthissection30(b)meansanybondsorrefundingbondsissuedby
19thehighwaysandtransportationcommissiontofinanceorrefinancetheconstructionor
20reconstructionofthestatehighwaysystem.
21 Second,tomaintainabalanceinthestateroadfundintheamountdeemednecessary
22tomeetthepaymentoftheprincipalandinterestofanystateroadbondsforthenext
23succeedingtwelvemonths.
24 Theremainingbalanceinthestateroadfundshallbeusedandexpended[inthesole
25discretionofandunderthesupervisionanddirectionofthehighwaysandtransportation
26commission] forthefollowingstatehighwaysystemusesandpurposesandnoother:
27 (1)Tocompleteandwidenorotherwiseimproveandmaintainthestatehighway
28systemheretoforedesignatedandlaidoutunderexistinglaws;
29 (2)Toreimbursethevariouscountiesandotherpoliticalsubdivisionsofthestate,
30exceptincorporatedcitiesandtowns,formoneyexpendedbythemintheconstructionor
31acquisitionofroadsandbridgesnoworhereaftertakenoverbythehighwaysand
32transportationcommissionaspermanentpartsofthestatehighwaysystem,totheextentof
33thevaluetothestateofsuchroadsandbridgesatthetimetakenover,notexceedinginany
34casetheamountexpendedbysuchcountiesandsubdivisionsintheconstructionor
35acquisitionofsuchroadsandbridges,exceptthatthehighwaysandtransportation
36commissionmay,initsdiscretion,repay,oragreetorepay,anycashadvancedbyacounty
37orsubdivisiontoexpeditestateroadconstructionorimprovement;
38 (3)Inthediscretionofthecommissiontoplan,locate,relocate,establish,acquire,
39constructandmaintainthefollowing:
40 (a)interstateandprimaryhighwayswithinthestate;
41 (b)supplementarystatehighwaysandbridgesineachcountyofthestate;
42 (c)statehighwaysandbridgesin,toandthroughstateparks,publicareasand
43reservations,andstateinstitutionsnoworhereafterestablishedtoconnectthesamewiththe
44statehighways,andalsonational,stateorlocalparkways,travelways,tourways,with
45coordinatedfacilities;
HJR83 2 46 (d)anytunnelorinterstatebridgeorpartthereof,wherenecessarytoconnectthestate
47highwaysofthisstatewiththoseofotherstates;
48 (e)anyhighwaywithinthestatewhennecessarytocomplywithanyfederallawor
49requirementwhichisorshallbecomeaconditiontothereceiptoffederalfunds;
50 (f)anyhighwayinanycityortownwhichisfoundnecessaryasacontinuationofany
51stateorfederalhighway,oranyconnectiontherewith,intoandthroughsuchcityortown;and
52 (g)additionalstatehighways,bridgesandtunnels,eitherincongestedtrafficareasof
53thestateorwhereneededtofacilitateandexpeditethemovementofthroughtraffic.
54 (4)Toacquirematerials,equipmentandbuildingsandtoemploysuchpersonnelas
55necessaryforthepurposesdescribedinthissubsection1;and
56 (5)Forsuchotherpurposesandcontingenciesrelatingandappertainingtothe
57constructionandmaintenanceofsuchstatehighwaysystemasthehighwaysand
58transportationcommissionmaydeemnecessaryandproper.
59 2.(1)Thestatesalestaxuponthesaleofmotorvehicles,trailers,motorcycles,
60mopedsandmotortricyclesattherateprovidedbylawonNovember2,2004,isleviedand
61imposedbythissectionuntiltherateischangedbylaworconstitutionalamendment.
62 (2)One-halfoftheproceedsfromthestatesalestaxonallmotorvehicles,trailers,
63motorcycles,mopedsandmotortricyclesshallbededicatedforhighwayandtransportation
64useandshallbeapportionedanddistributedasfollows:tenpercenttothecounties,fifteen
65percenttothecities,twopercenttobedepositedinthestatetransportationfund,whichis
66herebycreatedwithinthestatetreasurytobeusedinamannerprovidedbylawandseventy-
67threepercenttobedepositedinthestateroadfund.Theamountsapportionedanddistributed
68tothecountiesandcitiesshallbefurtherallocatedandusedasprovidedinsection30(a)of
69thisarticle.Theamountsallocatedanddistributedtothehighwaysandtransportation
70commissionforthestateroadfundshallbeusedasprovidedinsubsection1ofthissection30
71(b).Thesalestaxeswhichareapportionedanddistributedpursuanttothissubdivision(2)
72shallnotincludethosetaxesleviedandimposedpursuanttosections43(a)or47(a)ofthis
73article.Theterm"proceedsfromthestatesalestax"asusedinthissubdivision(2)shallmean
74andincludeallrevenuesreceivedbythedepartmentofrevenuefromthesaidsalestax,
75reducedonlybyrefundsforoverpaymentsanderroneouspaymentsofsuchtaxaspermitted
76bylawandactualcostsofcollectionbythedepartmentofrevenue(butnottoexceedthree
77percentoftheamountcollected).
78 (3)(i)FromandafterJuly1,2005,throughJune30,2006,twenty-fivepercentofthe
79remainingone-halfoftheproceedsofthestatesalestaxonallmotorvehicles,trailers,
80motorcycles,mopedsandmotortricycleswhichisnotdistributedbysubdivision(2)of
81subsection2ofthissection30(b)shallbedepositedinthestateroadbondfundwhichis
82herebycreatedwithinthestatetreasury;(ii)fromandafterJuly1,2006,throughJune30,
HJR83 3 832007,fiftypercentoftheaforesaidone-halfoftheproceedsofthestatesalestaxonallmotor
84vehicles,trailers,motorcycles,mopedsandmotortricycleswhichisnotdistributedby
85subdivision(2)ofsubsection2ofthissection30(b)shallbedepositedinthestateroadbond
86fund;(iii)fromandafterJuly1,2007,throughJune30,2008,seventy-fivepercentofthe
87aforesaidone-halfoftheproceedsofthestatesalestaxonallmotorvehicles,trailers,
88motorcycles,mopedsandmotortricycleswhichisnotdistributedbysubdivision(2)of
89subsection2ofthissection30(b)shallbedepositedinthestateroadbondfund;and(iv)from
90andafterJuly1,2008,onehundredpercentoftheaforesaidone-halfoftheproceedsofthe
91statesalestaxonallmotorvehicles,trailers,motorcycles,mopedsandmotortricycleswhich
92isnotdistributedbysubdivision(2)ofsubsection2ofthissection30(b)shallbedepositedin
93thestateroadbondfund.Moneysdepositedinthestateroadbondfundareherebydedicated
94toandshallonlybeusedtofundtherepaymentofbondsissuedbythehighwaysand
95transportationcommissiontofundtheconstructionandreconstructionofthestatehighway
96systemortofundrefundingbonds,exceptthatafterJanuary1,2009,thatportionofthe
97moneysinthestateroadbondfundwhichthecommissionerofadministrationandthe
98highwaysandtransportationcommissioneachcertifyisnotneededtomakepaymentsupon
99saidbondsortomaintainanadequatereserveformakingfuturepaymentsuponsaidbonds
100maybeappropriatedtothestateroadfund.Thehighwaysandtransportationcommission
101shallhaveauthoritytoissuestateroadbondsfortheusessetforthinthissubdivision(3).The
102netproceedsreceivedfromtheissuanceofsuchbondsshallbepaidintothestateroadfund
103andshallonlybeusedtofundconstructionorreconstructionofspecificprojectsforpartsof
104thestatehighwaysystemasdeterminedbythehighwaysandtransportationcommission.The
105moneysdepositedinthestateroadbondfundshallonlybewithdrawnbyappropriation
106pursuanttothisconstitution.Noobligationforthepaymentofmoneyssoappropriatedshall
107bepaidunlessthecommissionerofadministrationcertifiesitforpaymentandfurthercertifies
108thattheexpenditureisforausewhichisspecificallyauthorizedbytheprovisionsofthis
109subdivision(3).Theproceedsofthesalestaxwhicharesubjecttoallocationanddepositinto
110thestateroadbondfundpursuanttothissubdivision(3)shallnotincludetheproceedsofthe
111salestaxleviedandimposedpursuanttosections43(a)or47(a)ofthisarticlenorshallthey
112includetheproceedsofthatportionofthesalestaxapportioned,distributedanddedicatedto
113theschooldistricttrustfundonNovember2,2004.Theterm"proceedsfromthestatesales
114tax"asusedinthissubdivision(3)shallmeanandincludeallrevenuesreceivedbythe
115departmentofrevenuefromthesaidsalestax,reducedonlybyrefundsforoverpaymentsand
116erroneouspaymentsofsuchtaxaspermittedbylawandactualcostsofcollectionbythe
117departmentofrevenue(butnottoexceedthreepercentoftheamountcollected).
118 3.AfterJanuary1,1980,anyincreaseinstatelicensefeesandtaxesonmotor
119vehicles,trailers,motorcycles,mopedsandmotortricyclesotherthanthosetaxesdistributed
HJR83 4 120pursuanttosubsection2ofthissection30(b)shallbedistributedasfollows:tenpercenttothe
121counties,fifteenpercenttothecitiesandseventy-fivepercenttobedepositedinthestateroad
122fund.Theamountsdistributedshallbeapportionedanddistributedtothecountiesandcities
123asprovidedinsection30(a)ofthisarticle,tobeusedforhighwaypurposes.
124 4.Themoneysapportionedordistributedunderthissectiontothestateroadfund,the
125statetransportationfund,thestateroadbondfund,counties,cities,townsorvillagesshallnot
126beincludedwithinthedefinitionof"totalstaterevenues"asthattermisusedinsection17of
127ArticleXofthisconstitutionnorbeconsideredasan"expenseofstategovernment"asthat
128termisusedinsection20ofarticleXofthisconstitution.
SectionB.Pursuanttochapter116,andotherapplicableconstitutionalprovisionsand
2lawsofthisstateallowingthegeneralassemblytoadoptballotlanguageforthesubmissionof
3thisjointresolutiontothevotersofthisstate,theofficialsummarystatementofthis
4resolutionshallbeasfollows:
