AN ACT 
To amend chapter 67, RSMo, by adding thereto one new section relating to a property tax for 
special educational services. 
 
Be it enacted by the General Assembly of the State of Missouri, as follows: 
     Section A.  Chapter 67, RSMo, is amended by adding thereto 1 
one new section, to be known as section 67.115, to read as 2 
follows:3 
     67.115.  1.  The board of education of a metropolitan 1 
school district may impose a tax upon real property located 2 
within the district for the purpose of funding special  3 
educational services in the district.  The tax shall not  4 
exceed a rate of three cents per hundred dollars assessed 5 
valuation and shall be imposed solely for the purpose of 6 
funding special educational services in the district.  The  7 
tax authorized pursuant to this section shall not become 8 
effective unless the board of education of the metropolitan 9 
district submits to the voters residing within the district, 10 
at a general election, a proposal to authorize the school 11 
board of the metropolitan di strict to impose a tax under 12 
this section. 13 
     2.  The question of whether the tax authorized by this 14 
section shall be imposed shall be submitted in substantially 15 
the following form: 16

If a majority of the votes cast on the ques tion by the  29 
qualified voters voting thereon are in favor of the 30 
question, the tax shall become effective.  If a majority of  31 
the votes cast on the question by the qualified voters 32 
voting thereon are opposed to the question, the school board 33 
of the metropolitan district may not impose the tax 34 
authorized under this section unless and until the question 35 
is resubmitted under this section to the qualified voters 36 
and such question is approved by a majority of the qualified 37 
voters voting on the question. 38 
    3.  All revenue collected pursuant to this section 39 
shall be deposited in a special trust fund, which and shall 40 
be known as the "Special Educational Services Property Tax 41 
Trust Fund", and shall be used solely for the designated 42 
purposes. 43 
     4.  The provisions of chapter 137 and article X, 44 
section 22 of the Missouri Constitution shall apply to the 45 
tax authorized pursuant to this section. 46
