FIRST REGULAR SESSION SENATE BILL NO. 315 103RD GENERAL ASSEMBLY INTRODUCED BY SENATOR BLACK. 0683S.01I KRISTINA MARTIN, Secretary AN ACT To repeal section 262.217, RSMo, and to enact in lieu thereof one new section relating to the state fair commission. Be it enacted by the General Assembly of the State of Missouri, as follows: Section A. Section 262.217, RSMo, is repealed and one new 1 section enacted in lieu thereof, to be known as section 262.217, 2 to read as follows:3 262.217. Effective September 1, 1995, there is created 1 a "State Fair Commission" whose domicile for the purposes of 2 sections 262.215 to 262.280 shall be the department of 3 agriculture of this state. The commission shall consist of 4 [nine] twelve members, [two of whom shall be activ e farmers, 5 two of whom shall be either current members or past 6 presidents of county or regional fair boards, ] one of whom 7 shall be the director of the department of agriculture [, one 8 of whom shall be employed in agribusiness, and three at - 9 large members who shall be Missouri residents ]. The 10 director of the department of agriculture [shall be the 11 chairman of the commission until January 31, 1997, and ] 12 shall not be counted against membership from a congressional 13 district[, at which time]. The [chairman] chair shall be 14 elected from among the members of the commission by the 15 commission members. Such officer shall serve for a term of 16 two years. Commissioners shall be reimbursed for their 17 actual and necessary expenses incurred when attending 18 SB 315 2 meetings of the commission, to be paid from appropriations 19 made therefor. Commissioners shall be appointed by the 20 governor, with the advice and consent of the senate. [The 21 county fair association in the state may submit to the 22 governor a list of nominees for appointment, three from each 23 congressional district, for those commission members who are 24 required to be current members or past presidents of county 25 fair boards. Not more than four commissioners excluding the 26 director of agriculture shall be memb ers of the same 27 political party.] Each commissioner shall be a resident of 28 the state for five years prior to [his] the commissioner's 29 appointment. The eight initial commissioners shall be 30 appointed as follows: two shall be appointed for terms of 31 one year, two for terms of two years, two for terms of three 32 years and two for terms of four years. Their successors 33 shall be appointed for terms of four years. A commissioner 34 shall continue to serve until [his] a successor is appointed 35 and qualified. Whenever any vacancy occurs on the 36 commission, the governor shall fill the vacancy by 37 appointment for the remainder of the term of the 38 commissioner who was replaced. There shall be no more than 39 [two] three commission members from any congressional 40 district. 41
