FIRST REGULAR SESSION SENATE BILL NO. 350 103RD GENERAL ASSEMBLY INTRODUCED BY SENATOR FITZWATER. 1249S.01I KRISTINA MARTIN, Secretary AN ACT To amend chapter 536, RSMo, by adding thereto one new section relating to administrative rules. Be it enacted by the General Assembly of the State of Missouri, as follows: Section A. Chapter 536, RSMo, is amended by adding thereto 1 one new section, to be known as section 536.180, to read as 2 follows:3 536.180. 1. Any state agency filing a notice of 1 proposed rulemaking, as required by section 536.021, wherein 2 the adoption, amendment, or rescission of the rule would 3 require or result in an expenditure of public funds by or a 4 reduction in public revenues for that agency or any other 5 state agency in excess of two hundred fifty thousand dollars 6 shall, in addition to the requirements of section 536.200, 7 file notification with the joi nt committee on administrative 8 rules of such proposed rule. 9 2. Any proposed rule subject to the provisions of this 10 section shall not be subject to section 536.021 and shall 11 not become effective until the provisions of this section 12 have been satisfied. 13 3. A proposed rule subject to the provisions of this 14 section shall not become effective unless and until the 15 general assembly adopts a concurrent resolution in 16 accordance with the provisions of Article IV, Section 8 of 17 the Missouri Constitu tion to approve such proposed rule. 18 SB 350 2 4. Upon adoption of such concurrent resolution as 19 provided in subsection 3 of this section, the secretary of 20 state shall not publish the order of rulemaking until the 21 expiration of time necessary for such resolu tion to be 22 signed by the governor or vetoed and subsequently acted upon 23 by the general assembly as provided in Article III, Section 24 32 of the Missouri Constitution. If such concurrent 25 resolution is adopted and signed by the governor or 26 otherwise reconsidered under Article III, Section 32 of the 27 Missouri Constitution, the secretary of state shall publish 28 in the Missouri register, as soon as practicable, the order 29 of rulemaking along with notice of the proposed rules or 30 portions thereof that were ap proved by the general assembly. 31 5. Except as provided in section 536.025, any proposed 32 rule shall be null, void, and unenforceable unless made in 33 accordance with the provisions of this section. 34
