EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 13issuingaburnban,whichmaycarryapenaltyofuptoaclassAmisdemeanor.Stateagencies
14responsibleforfiremanagementorsuppressionactivitiesandpersonsconductingagricultural
15burningusingbestmanagementpracticesshallnotbesubjecttotheprovisionsofthis
16subsection.Theabilityofanindividual,organization,orcorporationtosellfireworksshall
17notbeaffectedbytheissuanceofaburnban.Thecountyburnbanmayprohibitthe
18explosionorignitionofanymissileorskyrocketastheterms"missile"and"skyrocket"are
19definedbythe[2012] 2022editionoftheAmericanFireworksStandardsLaboratory(AFSL),
20butshallnotbantheexplosionorignitionofanyotherconsumerfireworksastheterm
21"consumerfireworks"isdefinedundersection320.106.
22 4.Theregulationssoadoptedshallbecodified,printedandmadeavailableforpublic
23useandadequatesignsconcerningsmoking,trafficandparkingregulationsshallbeposted.

4distributor,wholesaler,[jobber] annualretailer,orseasonalretailerfromthestatefire
5marshalandapplicablefederalpermitorlicense.Possessionofsaidpermitisacondition
6precedenttomanufacturing,sellingorofferingforsale,shippingorcausingtobeshippedany
7fireworksintothestateofMissouri,exceptashereinprovided.Thisprovisionappliesto
8nonresidentsaswellasresidentsofthestateofMissouri.
9 2.Thestatefiremarshalhastheauthorityandisauthorizedanddirectedtoissue
10permitsforthesaleoffireworks.Nopermitshallbeissuedtoapersonundertheageof
11eighteenyears.Allpermitsexceptforseasonalretailersshallbeforthecalendaryearorany
12fractionthereofandshallexpireonthethirty-firstdayofDecemberofeachyear.
13 3.Permitsissuedmustbedisplayedinthepermitholder'splaceofbusiness.No
14permitprovidedforhereinshallbetransferablenorshallapersonoperateunderapermit
15issuedtoanotherpersonorunderapermitissuedforanotherlocation.Manufacturer,
16wholesaler,[jobber] annualretailer,anddistributorpermitholdersoperatingoutofmultiple
17locationsshallobtainapermitforeachlocation.
18 4.FailuretomakeapplicationforapermitbyMaythirty-firstofthecalendaryear
19mayresultinthefiremarshal'srefusaltoissuea[license] permittothe[licensee] permittee
20orapplicantforsuchcalendaryear.

75yearoryearshavenotbeenpaid;except,thissubsectionshallnotapplyifanapplicantis
76pursuinganyproperremedyatlawchallengingtheamount,collection,orassessmentofany
77salestax.
78 13.Aholderofadistributor,wholesaler,or[jobber's] annualretailer'spermitshall
79berequiredtooperateoutofapermanentstructureincompliancewithallapplicablebuilding
80andfireregulationsinthecityorcountyinwhichsaidpersonisoperatingafireworks
81business.Seasonalretailpermitlocationsshallbeincompliancewithallapplicablebuilding
82andfireregulations.Theapplicantmaybesubjecttoafiresafetyinspectionbythestatefire
83marshalbaseduponpromulgatedrulesandregulationsadoptedbythestatefiremarshal.
84 14.Itisunlawfulforanymanufacturer,distributor,wholesaler,or[jobber] annual
85retailertosellconsumerfireworkstoaseasonalretailerwhohasnotacquiredanappropriate
86permitfromthestatefiremarshalforthecurrentpermitperiod.Aseasonalretailershall
87acquireandpresenttheappropriatepermitfromthestatefiremarshalbeforeany
88manufacturer,distributor,wholesaleror[jobber] annualretailerisallowedtosell
89consumerfireworkstosuchseasonalretailer,providedthatsuchseasonalretaileris
90purchasingtheconsumerfireworksforresaleinthisstate.
91 15.Thestatefiremarshalandthemarshal'sdeputiesmayconductinspectionsofany
92premisesandallportionsofbuildingswherefireworksarestored,manufactured,keptor
93beingofferedforsale.Allpersonsselling,offeringforsale,barter,gift,exchange,oroffer
94thereofanyfireworksshallcooperatefullywiththestatefiremarshalandthemarshal's
95deputiesduringanysuchinspection.Thisinspectionshallbeperformedduringnormal
96businesshours.
97 16.Inadditiontoanyotherpenalty,anypersonwhomanufactures,sells,offersfor
98sale,shipsorcausestobeshippedintoorcausedtobeshippedintothestateofMissouri,for

100shallbeassessedacivilpenaltyofuptoaonethousanddollarfineforeachdayofoperation

320.116.1.Thestatefiremarshalmayrevokeanypermitorlicenseissuedpursuant
2tosections320.106to320.161uponevidencethattheholderhaswillfullyviolatedanyofthe
3provisionsofsections320.106to320.161.Ifaholderofapermithasmultiplepermitted
4locations,anysuspensionorrevocationshallonlyapplytothepermittedlocationwhere
5theviolationresultinginsuspensionorrevocationoccurred.
6 2.Thestatefiremarshalmayrevokeorsuspendanypermitissuedunder
7sections320.106to320.161uponevidencethattheinfluenceofalcoholoranyillicit
8controlledsubstanceistakingplacebyanypermitholder,employee,orrepresentative
9withinthepermittedannualorseasonalretailsaleslocationduringnormalbusiness
10hours.
11 3.Thestatefiremarshalmayrefusetoissuealicenseorpermittoanyapplicant
12whenthepermitorlicenseoftheindividual,corporation,orpartnerisundersuspension
13orrevocation.Thestatefiremarshalmayrefusetoissuealicenseorpermittoaperson
14whoisapartner,shareholder,manager,officer,spouse,orrelativeoftheapplicantora
15partytotheapplicant.
16 4.Thestatefiremarshal,inhisorherdiscretion,mayrefusetoissueapermit,fora
17periodnottoexceedthreeyears,toapersonwhosepermithasbeenrevokedforthe
18possessionorsaleofillegalfireworks,asreferredtoinsection320.136.

27thirtydays,thefireworksshallbedestroyedbythestatefiremarshal.Thestatefiremarshal
28shallseize,take,removeorcausetoberemoved,attheexpenseoftheowner,allstocksof
29fireworksofferedorexposedforsale,storedorheldinviolationoftheprovisionsofsections
30320.106to320.161.Allcosts,includinganyexpensesincurredwiththeseizure,shallbethe
31responsibilityoftheadjudicatedpartyifcasedispositionisinthefavorofthestatefire

33 [4.]6.Anypersonaggrievedbyanyofficialactionofthestatefiremarshalaffecting
34theirpermitstatusincludingrevocation,suspension,failuretorenewapermit,orrefusalto

8Onlyholdersofastateissuedmanufacturerordistributorpermitshallbeallowedtosell
9displayfireworksandarticlespyrotechnicwithinthestateofMissouri.Apermitted

19Forpossessionofdisplayfireworks,proofofanyrequiredfederallicenseorpermitshall
20bemaintainedbythepossessor.
21 4.[Permitsfordisplayorproximatefireworksmaybegrantedtomunicipalities,fair
22associations,amusementparks,organizations,persons,firmsorcorporations.Suchpermits
23maybegranteduponapplicationandapprovalbythestatefiremarshalorlocalfireservice
24authoritiesofthecommunitywherethedisplayisproposedtobeheld.Allapplications

28suchdisplayshallbesupervised,managed,ordirectedbyaMissourilicensedoperator,or
29pyrotechnicoperatoronsitepursuanttosubdivisions(11)and(18)ofsection320.106and
30shallbelocated,discharged,orfiredsoasintheopinionofthepermittingauthority,after
31properinspectionbasedonthemostcurrenteditionoftheNationalFireProtection
32Associationstandards,NFPA1123,1124,and1126,tonotbehazardoustoanypersonor
33property.Afterapermithasbeengranted,thesale,possession,useanddistributionof
34fireworksforsuchdisplayshallbelawfulforthatpurposeonly.Acopyofallpermitsissued
35fordisplayorproximatefireworksshallbeforwardedbythepermitholdertothestatefire
36marshal'soffice.Nopermitgrantedhereundershallbetransferableandshallapplytoonly
37onelocation.Noholderofamanufacturerordistributorpermitshallsell,barter,ortransfer
38displayorproximatefireworkstoanyonenotpossessinganapplicablepermitorlicense.
39 5.Possessionofdisplayorproximatefireworksshallbelimitedtoaholderofa
40displayorproximatefireworkspermitissuedbytheauthorityhavingjurisdictionwherethe
41displayorproximatefireworksisproposedtobeheldorthestatefiremarshalorholderofa
42statemanufacturerordistributorpermitandapplicablefederallicenseorpermit.
43 6.Beforeissuinganypermitforadisplayorproximatefireworks,themunicipality,
44fairassociation,amusementpark,organization,firm,persons,orcorporationmaking
45applicationthereforshallfurnishproofoffinancialresponsibilityinanamountestablishedby
46promulgatedruletothepermittingauthorityinordertosatisfyclaimsfordamagestoproperty

49 7.Anyestablishmentwhereproximatefireworksaretobedischargedshallbe

51withNFPA101LifeSafetyCodeorequivalentnationallyrecognizedcodeinrelationto
52meansofegress,occupancyload,andautomaticsprinklerandfirealarmsystems.Allpermits
53issuedwillbeforwardedtothestatefiremarshalbythepermitholder.Permitswillbeissued

17alocalfireserviceauthorityshallbeforwardedbythepermitholdertothestatefire
18marshal'sofficeuponrequest.Nopermitgrantedhereundershallbetransferableand
19eachpermitshallapplytoonlyonelocation.
20 2.Beforeissuinganypermitforoutdoorfireworksdisplayoradisplaybeforea
21proximateaudience,themunicipality,fairassociation,amusementpark,organization,
22firm,persons,orcorporationmakingapplicationthereforeshallfurnishproofof

15UnitedStatesConsumerProductSafetyCommissionandpermittedforusebythe
16generalpublicpursuanttosuchcommission'sregulations.
17 3.[Nojobber,wholesaler,manufacturer,ordistributorshallselltoseasonalretailer
18dealers,oranyotherperson,inthisstateforthepurposeofresale,oruse,inthisstate,any
19consumerfireworkswhichdonothavethenumbersandletter"1.4G"printedwithinan
20orange,diamond-shapedlabelprintedonorattachedtothefireworksshippingcarton.
21 4.]Thissectiondoesnotprohibitamanufacturer,distributororanyotherperson
22possessingtheproperpermitsasspecifiedbystateandfederallawfromstoring,selling,
23shippingorotherwisetransportingdisplayfireworksor[proximatefireworks] articles
24pyrotechnic.
25 [5.]4.Matches,toypistols,toycanes,toyguns,partypoppers,orotherdevicesin
26whichpapercapscontainingtwenty-fivehundredthsgrainsorlessofexplosivecompound,
27providedthattheyaresoconstructedthatthehandcannotcomeintocontactwiththecap
28wheninplaceforuse,andtoypistolpapercapswhichcontainlessthantwenty-five
29hundredthsgrainsofexplosivemixtureshallbepermittedforsaleanduseatalltimesand

7Suchinspectionshallbeperformedduringnormalbusinesshours.
8 2.Allnewconstructionorsubstantialimprovementsofapermanentstructure
9shallbeconstructedwithallapplicablebuildingcodesorfirecodesadoptedbythelocal
10politicalsubdivisiontowhomhasauthorityoversuchmatter.Allnewconstructionor
11substantialimprovementsofapermanentstructurelocatedinajurisdictionwithouta
