76pursuinganyproperremedyatlawchallengingtheamount,collection,orassessmentofany 77salestax. 78 13.Aholderofadistributor,wholesaler,or[jobber's] annualretailer'spermitshall 79berequiredtooperateoutofapermanentstructureincompliancewithallapplicablebuilding 80andfireregulationsinthecityorcountyinwhichsaidpersonisoperatingafireworks 81business.Seasonalretailpermitlocationsshallbeincompliancewithallapplicablebuilding 82andfireregulations.Theapplicantmaybesubjecttoafiresafetyinspectionbythestatefire 83marshalbaseduponpromulgatedrulesandregulationsadoptedbythestatefiremarshal. 84 14.Itisunlawfulforanymanufacturer,distributor,wholesaler,or[jobber] annual 85retailertosellconsumerfireworkstoaseasonalretailerwhohasnotacquiredanappropriate 86permitfromthestatefiremarshalforthecurrentpermitperiod.Aseasonalretailershall 87acquireandpresenttheappropriatepermitfromthestatefiremarshalbeforeany 88manufacturer,distributor,wholesaleror[jobber] annualretailerisallowedtosell 89consumerfireworkstosuchseasonalretailer,providedthatsuchseasonalretaileris 90purchasingtheconsumerfireworksforresaleinthisstate. 91 15.Thestatefiremarshalandthemarshal'sdeputiesmayconductinspectionsofany 92premisesandallportionsofbuildingswherefireworksarestored,manufactured,keptor 93beingofferedforsale.Allpersonsselling,offeringforsale,barter,gift,exchange,oroffer 94thereofanyfireworksshallcooperatefullywiththestatefiremarshalandthemarshal's 95deputiesduringanysuchinspection.Thisinspectionshallbeperformedduringnormal 96businesshours. 97 16.Inadditiontoanyotherpenalty,anypersonwhomanufactures,sells,offersfor 98sale,shipsorcausestobeshippedintoorcausedtobeshippedintothestateofMissouri,for HCSSSSCSSBs81&174 8 99useinMissouri,anyitemsoffireworkswithoutfirsthavingtherequiredapplicablepermit 100shallbeassessedacivilpenaltyofuptoaonethousanddollarfineforeachdayofoperation 101uptoamaximumoftenthousanddollars. 320.116.1.Thestatefiremarshalmayrevokeanypermitorlicenseissuedpursuant 2tosections320.106to320.161uponevidencethattheholderhaswillfullyviolatedanyofthe 3provisionsofsections320.106to320.161.Ifaholderofapermithasmultiplepermitted 4locations,anysuspensionorrevocationshallonlyapplytothepermittedlocationwhere 5theviolationresultinginsuspensionorrevocationoccurred. 6 2.Thestatefiremarshalmayrevokeorsuspendanypermitissuedunder 21pursuanttosections320.106to320.161.Suchillegalfireworksseizedintheenforcementof 22sections320.106to320.161shallbeheldincustodyofthestatefiremarshalinproperstorage 23facilities.Thepersonsurrenderingthefireworksmaybringaninremproceedinginthe 24circuitcourtofthecountywherethefireworkswereseized.Uponhearing,thecircuitcourt 25mayauthorizethereturnofallorpartoftheconfiscatedfireworksorthecourtmayauthorize 26anddirectthatsuchcontrabandfireworksbedestroyed.Ifaproceedingisnotbroughtwithin 27thirtydays,thefireworksshallbedestroyedbythestatefiremarshal.Thestatefiremarshal 28shallseize,take,removeorcausetoberemoved,attheexpenseoftheowner,allstocksof 29fireworksofferedorexposedforsale,storedorheldinviolationoftheprovisionsofsections 30320.106to320.161.Allcosts,includinganyexpensesincurredwiththeseizure,shallbethe 31responsibilityoftheadjudicatedpartyifcasedispositionisinthefavorofthestatefire 32marshal. 33 [4.]6.Anypersonaggrievedbyanyofficialactionofthestatefiremarshalaffecting 34theirpermitstatusincludingrevocation,suspension,failuretorenewapermit,orrefusalto HCSSSSCSSBs81&174 9 35grantapermitmayseekadeterminationthereonbytheadministrativehearingcommission 36pursuanttotheprovisionsofsection621.045. 320.121.1.Theprovisionsofsections320.106to320.161shallnotbeconstruedto 2abrogateorinanywayaffectthepowersofthefollowingpoliticalsubdivisionstoregulateor 3prohibitfireworkswithinitscorporatelimits: 4 (1)Anycity,town,orvillageinthisstate;or 5 (2)Anycountyoperatingunderacharterformofgovernment. 6 2.Itisunlawfulforanymanufacturer,distributor,wholesaler,[jobber] annual 7retailer,orseasonalretailertosellorshipbycommoncarrierfireworkstoconsumerswithin 8thecorporatelimitsofthefollowingpoliticalsubdivisionswhichprohibitthesaleor 9possessionoffireworks: 10 (1)Anycity,town,orvillageinthisstate;or 11 (2)Anycountyoperatingunderacharterformofgovernment. 320.126.1.Anyperson,entity,partnership,corporation,orassociationtransporting 2displayfireworksor[proximatefireworks] articlespyrotechnicordisplayfireworksand 3[proximatefireworks] articlespyrotechnicintothestateofMissouriforthepurposeofresale 4[ortoconductadisplay] shallbepermittedbythestatefiremarshalasadistributoror 5manufacturerandhaveobtainedanyapplicablefederallicenseorpermit. 6 2.[Saleofdisplayorproximatefireworksshallbelimitedtoaholderofafederal 7licenseorpermitandadistributorormanufacturerpermitissuedbythestatefiremarshal] 8Onlyholdersofastateissuedmanufacturerordistributorpermitshallbeallowedtosell 9displayfireworksandarticlespyrotechnicwithinthestateofMissouri.Apermitted 10manufacturerordistributormayselldisplayfireworksandarticlespyrotechniconlyto 11thosepersonswhomaintaineitherastateissuedmanufacturerordistributorpermitor 12avalidstateissueddisplayoperatorlicenseorpyrotechniceffectoperatorlicense.For 13thesaleofdisplayfireworks,proofofanyrequiredfederallicenseorpermitshallbe 14requiredpriortofinalizinganysellortransfer. 15 3.Possessionofdisplay[orproximatefireworksforresaletoholdersofapermitfor 16displayorproximate] fireworksorarticlespyrotechnicshallbeconfinedtoholdersofastate 17manufacturerordistributorpermit[andapplicablefederallicenseorpermit] orholdersor 18eitheravalidstateissueddisplayoperatorlicenseorpyrotechniceffectoperatorlicense. 19Forpossessionofdisplayfireworks,proofofanyrequiredfederallicenseorpermitshall 20bemaintainedbythepossessor. 21 4.[Permitsfordisplayorproximatefireworksmaybegrantedtomunicipalities,fair 22associations,amusementparks,organizations,persons,firmsorcorporations.Suchpermits 23maybegranteduponapplicationandapprovalbythestatefiremarshalorlocalfireservice 24authoritiesofthecommunitywherethedisplayisproposedtobeheld.Allapplications HCSSSSCSSBs81&174 10 25submittedfordisplayorproximatefireworkspermitsmustbesubmittedtotheofficeofthe 26statefiremarshalaminimumoftenworkingdayspriortothedateoftheevent.The 27applicationshallbemadeonaformprovidedorapprovedbythestatefiremarshal.Every 28suchdisplayshallbesupervised,managed,ordirectedbyaMissourilicensedoperator,or 29pyrotechnicoperatoronsitepursuanttosubdivisions(11)and(18)ofsection320.106and 30shallbelocated,discharged,orfiredsoasintheopinionofthepermittingauthority,after 31properinspectionbasedonthemostcurrenteditionoftheNationalFireProtection 32Associationstandards,NFPA1123,1124,and1126,tonotbehazardoustoanypersonor 33property.Afterapermithasbeengranted,thesale,possession,useanddistributionof 34fireworksforsuchdisplayshallbelawfulforthatpurposeonly.Acopyofallpermitsissued 35fordisplayorproximatefireworksshallbeforwardedbythepermitholdertothestatefire 36marshal'soffice.Nopermitgrantedhereundershallbetransferableandshallapplytoonly 37onelocation.Noholderofamanufacturerordistributorpermitshallsell,barter,ortransfer 38displayorproximatefireworkstoanyonenotpossessinganapplicablepermitorlicense. 39 5.Possessionofdisplayorproximatefireworksshallbelimitedtoaholderofa 40displayorproximatefireworkspermitissuedbytheauthorityhavingjurisdictionwherethe 41displayorproximatefireworksisproposedtobeheldorthestatefiremarshalorholderofa 42statemanufacturerordistributorpermitandapplicablefederallicenseorpermit. 43 6.Beforeissuinganypermitforadisplayorproximatefireworks,themunicipality, 44fairassociation,amusementpark,organization,firm,persons,orcorporationmaking 45applicationthereforshallfurnishproofoffinancialresponsibilityinanamountestablishedby 46promulgatedruletothepermittingauthorityinordertosatisfyclaimsfordamagestoproperty 47orpersonalinjuriesarisingoutofanyactoromissiononthepartofsuchperson,firmor 48corporationoranyagentoremployeethereof. 49 7.Anyestablishmentwhereproximatefireworksaretobedischargedshallbe 50inspectedbythestatefiremarshalorlocalfiredepartmenthavingjurisdictionforcompliance 51withNFPA101LifeSafetyCodeorequivalentnationallyrecognizedcodeinrelationto 52meansofegress,occupancyload,andautomaticsprinklerandfirealarmsystems.Allpermits 53issuedwillbeforwardedtothestatefiremarshalbythepermitholder.Permitswillbeissued 54inthesamemannerasthoserequiredinthissection] Thissectionshallnotbeconstruedto 55prohibitaholderofamanufacturerordistributorpermitfromtransportingorselling 56displayfireworksorarticlespyrotechnictopersonswhoarenotresidentsofthisstate. 320.127.1.Permitsforoutdoorfireworksdisplaysordisplaysbeforea 2proximateaudiencemaybegrantedtomunicipalities,fairassociations,amusement 3parks,organizations,persons,firms,orcorporations.Suchpermitsmaybegranted 4uponapplicationandapprovalbythestatefiremarshalorlocalfireserviceauthorities 5ofthecommunitywheretheoutdoorfireworksdisplayorthedisplaybeforeaproximate HCSSSSCSSBs81&174 11 6audienceisproposedtobeheld.Allapplicationssubmittedtothestatefiremarshalfor 7anoutdoorfireworksdisplaypermitoradisplaybeforeaproximateaudiencepermit 8shallbesubmittedtotheofficeofthestatefiremarshalaminimumoftenworkingdays 9priortothedateoftheevent.Theapplicationshallbemadeonaformprovidedor 10approvedbythestatefiremarshal.Everysuchoutdoorfireworksdisplayordisplay 11beforeaproximateaudienceshallbesupervised,managed,ordirectedbyaMissouri 12licenseddisplayoperator,orpyrotechniceffectsoperatoronsiteandshallbelocated, 13discharged,orfiredsoasintheopinionofthepermittingauthority,afterproper 14inspectionbasedontheNationalFireProtectionAssociationstandards,NFPA1123, 151124,and1126,tonotbehazardoustoanypersonorproperty.Acopyofallpermits 16issuedforoutdoorfireworksdisplaysordisplaysbeforeaproximateaudienceissuedby 17alocalfireserviceauthorityshallbeforwardedbythepermitholdertothestatefire 18marshal'sofficeuponrequest.Nopermitgrantedhereundershallbetransferableand 19eachpermitshallapplytoonlyonelocation. 20 2.Beforeissuinganypermitforoutdoorfireworksdisplayoradisplaybeforea 21proximateaudience,themunicipality,fairassociation,amusementpark,organization, 22firm,persons,orcorporationmakingapplicationthereforeshallfurnishproofof 23financialresponsibilityinanamountestablishedbypromulgatedruletothepermitting 24authorityinordertosatisfyclaimsfordamagestopropertyorpersonalinjuriesarising 25outofanyactoromissiononthepartofsuchperson,firm,orcorporationoranyagent 26oremployeethereof. 27 3.Anyestablishment,venue,orshootsitewhereanoutdoorfireworksdisplayor 28adisplaybeforeaproximateaudienceistotakeplaceshallbeinspectedbythestatefire 29marshalorlocalfiredepartmenthavingjurisdictionforcompliancewithNFPA1123 30CodeforFireworksDisplay,NFPA1126CodefortheUseofPyrotechnicsBeforea 31ProximateAudience,andNFPA101LifeSafetyCodeorequivalentnationally 32recognizedcodeinrelationtomeansofegress,occupancyload,andautomatic 33sprinklerandfirealarmsystems.Allpermitsissuedshallbeforwardedtothestatefire 34marshalbythepermitholder,uponthestatefiremarshal'srequest.Permitsshallbe 35issuedinthesamemannerasthoserequiredinthissection. 36 4.Notwithstandinganyprovisionsofthissectiontothecontrary,aholderofa 37validstateissueddisplayoperatorlicenseconductingaprivateoutdoorfireworkdisplay 38foranon-commercialpurposeshallnotbesubjecttothepermittingrequirementsin 39subsections1through3ofthissection;provided,however,thatallsuchnon-commercial, 40privateoutdoorfireworkdisplaysshallbeconductedincompliancewithNFPA1123and 41anyordinance,rule,orregulationpromulgatedbythelocalauthorityhaving 42jurisdictionoverthelocationwheretheprivateoutdoorfireworkdisplaywillbeheld. HCSSSSCSSBs81&174 12 43Thestatefiremarshalmay,throughitsrulemakingauthoritysetoutinchapters320 44and536,establishareasonablenotice-onlyrulerequiringthelicenseddisplayoperator 45tonotifythelocalauthorityhavingjurisdictionoversuchmattersatleastfivecalendar 46dayspriortotheprivateoutdoorfireworkdisplayeventdescribedinthissubsection. 47Forthepurposesofthissection,"non-commercialpurpose"shallmeannotconnected 48withorengagedinforacommercialpurposeorinexchangeforanymonetary 49consideration. 320.131.1.Itisunlawfulforanypersontopossess,sellorusewithinthestateof 2Missouri,orshipintothestateofMissouri,exceptasprovidedinsection320.126,any 3pyrotechnicscommonlyknownas"fireworks"anddefinedasconsumerfireworksin 4[subdivision(3)of]section320.106[otherthanitemsnoworhereafterclassifiedasfireworks 5UNO336,1.4GbytheUnitedStatesDepartmentofTransportation] thatcomplywiththe 6construction,chemicalcomposition,labelingandotherregulationsrelativetoconsumer 7fireworksregulationspromulgatedbytheUnitedStatesConsumerProductSafety 8Commissionandpermittedforusebythegeneralpublicpursuanttosuchcommission's 9regulations. 10 2.Nowholesaler,[jobber] annualretailer, orseasonalretailer,oranyotherperson 11shallsell,offerforsale,store,display,orhaveintheirpossessionanyconsumerfireworks 12[thathavenotbeenapprovedasfireworksUNO336,1.4GbytheUnitedStatesDepartmentof 13Transportation] thatdonotcomplywiththeconstruction,chemicalcomposition,labeling, 14andotherregulationsrelativetoconsumerfireworksregulationspromulgatedbythe 15UnitedStatesConsumerProductSafetyCommissionandpermittedforusebythe 16generalpublicpursuanttosuchcommission'sregulations. 17 3.[Nojobber,wholesaler,manufacturer,ordistributorshallselltoseasonalretailer 18dealers,oranyotherperson,inthisstateforthepurposeofresale,oruse,inthisstate,any 19consumerfireworkswhichdonothavethenumbersandletter"1.4G"printedwithinan 20orange,diamond-shapedlabelprintedonorattachedtothefireworksshippingcarton. 21 4.]Thissectiondoesnotprohibitamanufacturer,distributororanyotherperson 22possessingtheproperpermitsasspecifiedbystateandfederallawfromstoring,selling, 23shippingorotherwisetransportingdisplayfireworksor[proximatefireworks] articles 24pyrotechnic. 25 [5.]4.Matches,toypistols,toycanes,toyguns,partypoppers,orotherdevicesin 26whichpapercapscontainingtwenty-fivehundredthsgrainsorlessofexplosivecompound, 27providedthattheyaresoconstructedthatthehandcannotcomeintocontactwiththecap 28wheninplaceforuse,andtoypistolpapercapswhichcontainlessthantwenty-five 29hundredthsgrainsofexplosivemixtureshallbepermittedforsaleanduseatalltimesand 30shallnotberegulatedbytheprovisionsofsections320.106to320.161. HCSSSSCSSBs81&174 13 320.141.Permissibleitemsofconsumerfireworksdefinedinsection320.131maybe 2soldatwholesaleorretailbyholdersof[ajobber's] anannualretailerpermitto 3[nonlicensed] nonpermittedbuyers[fromoutsidethestateofMissouri] duringacalendar 4yearfromthefirstdayofJanuaryuntilthethirty-firstdayofDecember.Permissibleitemsof 5consumerfireworksdefinedinsection320.131maybesoldatretailbyholdersofaseasonal 6retailpermitduringthesellingperiodsofthetwentiethdayofJunethroughthetenthdayof 7JulyandthetwentiethdayofDecemberthroughtheseconddayofJanuary. 320.147.1.Apersonsellingorofferingfireworksforsaleorbarterortrade 2shallpermitthestatefiremarshalandthemarshal'sdeputiestoconductinspections, 3basedonthecodeofstateregulations,ofthebusinesspremisesoranylocationwhere 4fireworksarestored,kept,orsold.Suchpersonshallcooperatewithsuchinspectionor 5investigation.Failuretocooperateorrefusaltoallowaninspectionshallresultin 6suspensionorrevocationofthepermittee'spermitorrefusalofapermittobeissued. 7Suchinspectionshallbeperformedduringnormalbusinesshours. 8 2.Allnewconstructionorsubstantialimprovementsofapermanentstructure 9shallbeconstructedwithallapplicablebuildingcodesorfirecodesadoptedbythelocal 10politicalsubdivisiontowhomhasauthorityoversuchmatter.Allnewconstructionor 11substantialimprovementsofapermanentstructurelocatedinajurisdictionwithouta 12localbuildingcodeorfirecodeshallsubmitafullsetofconstructionplanstothestate 13firemarshalforreview.Thestatefiremarshalmayreviewsuchplansforcompliance 14withfireprotectionstandardsandissuerecommendations. 320.151.1.Itisunlawfultoattempttosellortosellatretailanyfireworksto 2childrenundertheageoffourteenyearsexceptwhensuchchildisinthepresenceofaparent 3orguardian. 4 2.Itisunlawfulforanypersonundertheageofsixteentosellfireworksorworkina 5facilitywherefireworksarestored,sold,orofferedforsaleunlesssupervisedbyanadult. 6 3.Itisunlawfultoexplodeorigniteconsumerfireworkswithinsixhundredfeetof 7anychurch,hospital,mentalhealthfacility,school,orwithinonehundredfeetofanylocation 8wherefireworksarestored,sold,orofferedforsale. 9 4.Nopersonshalligniteordischargeanypermissiblearticlesofconsumerfireworks 10withinorthrowthesamefromamotorizedvehicleincludingwatercraftoranyothermeansof 11transportation,exceptwheredisplaypermithasbeenissuedforafloatingvesselorfloating 12platform,norshallanypersonplaceorthrowanyignitedarticleoffireworksintoorata 13motorizedvehicleincludingwatercraftoranyothermeansoftransportation,oratornearany 14personorgroupofpeople. HCSSSSCSSBs81&174 14 15 5.Nopersonshalligniteordischargeconsumerfireworkswithinthreehundredfeet 16ofanypermanentstorageofignitableliquid,gases,gasolinepump,gasolinefillingstation,or 17anynonpermanentstructurewherefireworksarestored,soldorofferedforsale. 18 6.Noitemsofexplosiveorpyrotechniccompositionotherthan[fireworksasdefined 19bysubdivisions(3),(5),and(17)ofsection320.106] consumerfireworks,display 20fireworks,orarticlespyrotechnicshallbedisplayed,sold,orofferedforsalewithinthe 21applicablepermitlocationasidentifiedonsuchpermitgrantedbythestatefiremarshal. 22 7.[Proximatefireworksshallnotbeallowedtobestoredwithconsumerfireworks. 23 8.]Allstorageandtransportationoffireworksshallbeinaccordancewithallfederal 24andstaterulesandregulations. 25 [9.]8.Nothinginsections320.106to320.161shallbeconstruedtoprevent 26permitteesfromdemonstratingortestingfireworks.Anysuchdemonstrationortestshall 27requirethenotificationandapprovalofthelocalfireserviceorthestatefiremarshal. 320.371.1.Thereisherebycreatedinthestatetreasurythe"CigaretteFireSafety 2StandardandFirefighterProtectionActFund"whichshallconsistofmoneyscollectedunder 3sections320.106to320.161andsections320.350to320.374.Thefundshallbe 4administeredbythestatefiremarshal.Uponappropriation,moneysinthefundshallbemade 5availabletothestatefiremarshaltosupportfiresafetyandpreventionprograms. 6 2.Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 7remaininginthefundattheendofthebienniumshallnotreverttothecreditofthegeneral 8revenuefund. 9 3.Thestatetreasurershallinvestmoneysinthefundinthesamemannerasother 10fundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedto 11thefund. 568.070.1.Apersoncommitstheoffenseofunlawfultransactionswithachildifhe 2orshe: 3 (1)Beingapawnbroker,junkdealer,dealerinsecondhandgoods,oranyemployeeof 4suchperson,withcriminalnegligencebuysorreceivesanypersonalpropertyotherthan 5agriculturalproductsfromanunemancipatedminor,unlessthechild'scustodialparentor 6guardianhasconsentedinwritingtothetransaction;or 7 (2)Knowinglypermitsaminorchildtoenterorremaininaplacewhereillegal 8activityincontrolledsubstances,asdefinedinchapter579,ismaintainedorconducted;or 9 (3)Withcriminalnegligencesellsblastingcaps,bulkgunpowder,orexplosivestoa 10childundertheageofseventeen,orfireworksasdefinedinsection[320.110]320.106, toa 11childundertheageoffourteen,unlessthechild'scustodialparentorguardianhasconsented 12inwritingtothetransaction.Criminalnegligenceastotheageofthechildisnotanelement 13ofthiscrime.
