GILLETTE 3 4 A BILL FOR AN ACT ENTITLED: βAN ACT PROVIDING THAT THE DEPARTMENT OF CORRECTIONS 5 SHALL CONSIDER AN INMATE'S FAMILY ATTACHMENTS WHEN MAKING OUT-OF-STATE 6 PLACEMENTS; AND AMENDING SECTION 53-30-106, MCA.β 7 8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA: 9 10 NEW SECTION. Section 1. When an inmate in a state 11 prison is placed in or transferred to a correctional institution located outside of the state, the department shall 12 consider the inmate's attachment to family and the inmate's ability to maintain those attachments. 13 14 Section 53-30-106, MCA, is amended to read: 15 "53-30-106. (1) If 16 the inmate population of a correctional institution or system exceeds the emergency capacity for 30 consecutive 17 days, the director of the department of corrections may declare that the emergency capacity has been 18 exceeded and temporarily stop admissions to the institution or system. The director shall notify each sheriff and 19 district court that new inmates will not be accepted by the department for admission into the institution or 20 system until the inmate population is reduced to 95% or less of the emergency capacity. Persons committed to 21 the department and persons sought to be admitted remain in the department's legal custody but must be kept in 22 a detention center in the jurisdiction holding them. In the event the jurisdiction holding the inmate is at maximum 23 capacity, the inmate may be placed in an available detention center in another jurisdiction. The department 24 shall reimburse that jurisdiction for the cost of detention for the period beyond the normal time of delivery to a 25 correctional institution administered by the department. Reimbursement must be at a rate mutually agreeable to 26 the department and the jurisdiction holding the person. The rate must cover the reasonable costs of the holding 27 jurisdiction. Expenses for medication, medical services, or hospitalization for persons confined in a detention 28 center under this section must be paid by the department. **** 69th Legislature 2025 HB 707.1 - 2 - Authorized Print Version β HB 707 1 (2) The department may enter into contracts with the federal government, other states, or the 2 commissioners of counties that have suitable detention centers for confining inmates committed to a 3 correctional institution or system administered by the department, either because a correctional institution or 4 system has exceeded its emergency capacity or because the department has no institution that is adequate for 5 certain inmates. 6 (3) Within budgetary limits and in compliance with [section 1], the department may also enter into 7 contracts with public or private corporations for the confinement of selected inmates if suitable programs have 8 been established." 9 10 NEW SECTION. Section 3. [Section 1] is intended to be codified as an 11 integral part of Title 53, chapter 30, part 1, and the provisions of Title 53, chapter 30, part 1, apply to [section 1]. 12 - END -
