4 A BILL FOR AN ACT ENTITLED: β€œAN ACT REVISING THE MEMBERSHIP OF THE PUBLIC SAFETY 
5 OFFICER STANDARDS AND TRAINING COUNCIL; AMENDING SECTION 44-4-402, MCA; AND PROVIDING 
6 AN IMMEDIATE EFFECTIVE DATE.”

8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

10 Section 44-4-402, MCA, is amended to read:
11 "44-4-402.  (1) The council consists of no more than 13 voting 
12 members appointed by the governor in accordance with 2-15-124 and as provided in this section.
13 (2) Membership must include:
14 (a) one state government law enforcement representative;
15 (b) one chief of police, who may be appointed based on recommendations from the Montana 
16 association of chiefs of police;
17 (c) one sheriff, who may be appointed based on recommendations from the Montana sheriffs and 
18 peace officers association;
19 (d) one representative from the department of corrections established in 2-15-2301;
20 (e) one local law enforcement officer in a nonadministrative position, who may be appointed based 
21 on recommendations from the Montana police protective association;
22 (f) one detention center administrator or detention officer;
23 (g) one Montana-certified tribal law enforcement representative;
24 (h) one county attorney, who may be appointed based on recommendations from the Montana 
25 county attorneys association;
26 (i) two members one member of the board of crime control established in 2-15-2008;
27 (j) one public safety communications officer as defined in 7-31-201 who may be appointed based 
28 on recommendations from the Montana association of public safety  ASSOCIATION OF PUBLIC-  - 2025

1 communications officials;
2 (j)(k) one misdemeanor probation officer, as defined in 46-23-1001, who is certified by the Montana 
3 public safety officer standards and training council and who may be appointed based on recommendations from 
4 an association representing misdemeanor probation officers; and
5 (k)(l) two Montana citizens at large who are informed and experienced in the subject of law 
6 enforcement."

8 NEW SECTION. Section 2.  [This act] is effective on passage and approval.
