ZOLNIKOV 3 4 A BILL FOR AN ACT ENTITLED: “AN ACT GENERALLY REVISING UTILITY LINES AND FACILITIES LAWS; 5 ALLOWING THE COMMISSION TO GRANT A PUBLIC UTILITY A CERTIFICATE OF PUBLIC 6 CONVENIENCE AND NECESSITY FOR ELECTRIC TRANSMISSION FACILITY CONSTRUCTION; 7 ESTABLISHING OPTIONAL RATEMAKING PROCEDURES AND TIMELINES; PROVIDING RULEMAKING 8 AUTHORITY; PROVIDING DEFINITIONS; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.” 9 10 WHEREAS, advanced transmission technology offers multiple advantages, including increased 11 capacity on existing transmission infrastructure, significantly reduced wildfire risk, and improved grid reliability, 12 and is a cost-effective solution to Montana's current congestion and curtailments of transmission pathways; and 13 WHEREAS, the intention of this legislation is to expedite the necessary and overdue transmission 14 upgrades needed to serve the ever-increasing demand of power; and 15 16 WHEREAS, the Public Service Commission has the decisionmaking authority to determine the balance 17 between modernizing the grid to increase reliability and identifying what costs are reasonable or unreasonable 18 to ensure ratepayer affordability. 19 20 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA: 21 22 NEW SECTION. Section 1. As used IN [sections 1 through 3], unless the context clearly 23 indicates otherwise, the following definitions apply: 24 (1) "Advanced transmission technology" means a technology that increases the capacity, 25 efficiency, and reliability of an existing or new transmission facility, as defined in 42 U.S.C. 16422. For the 26 purposes of [sections 1 through 3], the term applies to the following technology: 27 (a) underground cables; 28 (b) advanced conductor technology, such as advanced composite conductors, high temperature - 2025 69th Legislature 2025 SB0301.2 - 2 - Authorized Print Version – SB 301 1 low-sag conductors, and fiber optic temperature sensing conductors; 2 (c) high-capacity ceramic electric wire, connectors, and insulators; 3 (d) high-voltage direct-current technology; 4 (e) flexible alternate-current transmission systems; 5 6 (f) energy storage devices, such as pumped storage hydropower, compressed air, 7 superconducting magnetic energy storage, flywheels, and batteries; 8 9 (g) distributed generation, such as photovoltaic solar cells, fuel cells, and microturbines; 10 (h) (F) enhanced power device monitoring; 11 (i) direct system-state sensors; 12 (j) (G) power electronics and related software, including real-time monitoring and analytical software; 13 and 14 (k) (H) any other technologies the commission considers appropriate. 15 (2) "Certificate of public convenience and necessity" means a written authorization to operate 16 issued by the commission for constructing an electric transmission facility. 17 (3) "Department" means the department of environmental quality provided for in 2-15-3501. 18 (4) "Transmission facility" means those facilities that are controlled or operated by a utility and 19 used to provide transmission services as determined by the federal energy regulatory commission and the 20 public service commission. The term includes advanced transmission technology. 21 22 NEW SECTION. Section 2. 23 (1) A public utility, as defined in 69-3-101, or any other entity required to 24 submit a certification application to the department pursuant to Title 75, chapter 20, may request a certificate of 25 public convenience and necessity from the commission prior to commencing actual construction work on an 26 electric transmission facility that is rated higher than 69 kilovolts. 27 (2) A UTILITY MAY REQUEST A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FROM THE 28 PURSUANT TO SUBSECTION (1).THE UTILITY THE COMMISSION IN WRITING THAT IT SEEKS - 2025 69th Legislature 2025 SB0301.2 - 3 - Authorized Print Version – SB 301 1 CERTIFICATE. IF THE UTILITY NOTIFIES THE COMMISSION PURSUANT TO THIS SUBSECTION, THE DEPARTMENT MAY 2 SUBSECTIONS 75-20-301(1)(A), (1)(D)(III), AND (1)(F). 3 (2) (3) (a) Upon receiving a request from a public utility or entity, the commission shall determine 4 within 270 300 days whether the construction of the proposed transmission facility is in the public interest and 5 may grant or deny the certificate of public convenience and necessity. 6 (b) In making a determination, the commission may consider: 7 (i) the need for the proposed transmission facility to ensure reliable service for customers; 8 (ii) the ability of the proposed transmission facility to improve customer access to reliable and cost- 9 effective electric generation or storage facilities; 10 (iii) the anticipated costs and benefits of the proposed facility; 11 (iv) the use of advanced transmission technology; and 12 (v) any other factors deemed appropriate by the commission. 13 (3) (4) A commission-approved certificate of public convenience and necessity may satisfy the 14 requirements set forth in 75-20-301(1)(a), (1)(d), AND (1)(f), and (2) when the department considers siting 15 applications for proposed transmission facilities. 16 (4) (5) The commission shall adopt rules for the implementation of this section. 17 (6) NT75, CHAPTER 20. 18 19 NEW SECTION. SECTION 3. PPROVAL OF TRANSMISSION AND RELATED FACILITIES. (1) A PUBLIC UTILITY 20, 21[SECTION 2]. 22 (2) Within 45 days of a utility's application, the commission shall determine if the application is 23 adequate and in compliance with the commission's minimum filing requirements. If the commission determines 24 the application is inadequate, it shall explain the deficiencies. 25 (3) The commission shall issue an order within 90 days after receiving an application for 26 transmission lines and related facilities, unless the commission determines that extraordinary circumstances 27 warrant additional time. 28 (4) Subject to [section 2(2)] and after the applicant meets the remaining requirements of Title 75, - 2025 69th Legislature 2025 SB0301.2 - 4 - Authorized Print Version – SB 301 1 chapter 20, the commission may: 2 (a) approve or deny, in whole or in part: 3 (i) an application for approval of transmission lines and facilities; and 4 (ii) cost recovery for costs not prudently incurred; and 5 (b) consider all relevant information until the administrative record in the proceeding is closed for 6 the commission's evaluation of an application. 7 8 9 NEW SECTION. Section 3. Electric transmission optional ratemaking procedures -- 10 .. (1) A public utility operating electric transmission facilities that are part of a bulk electric system 11 subject to regulation by the federal energy regulatory commission and whose rates are set by the federal 12 energy regulatory commission using a formula rate process is eligible for optional ratemaking procedures as 13 described in this section. 14 15 (2) An eligible public utility may establish the optional ratemaking procedures in a general rate 16 filing pursuant to Title 69, chapter 3, part 3. If the public utility is eligible and the proposed optional ratemaking 17 procedures are consistent with this section, the commission may ap prove optional ratemaking procedures that 18 include the following elements: 19 20 (a) The revenues and costs associated with providing electric transmission service must be 21 unbundled from the revenues and costs associated with providing all other services. Cost recovery and savings 22 from advanced transmission technology compared to legacy transmission technology must be considered over 23 the expected life of the transmission line. 24 25 (b) The rates associated with the provisions of electric transmission service m ust be set annually 26 using forecasted revenues and costs expected over a 12-month perio d, including forecasted revenues the 27 public utility anticipates it will collect from the provisions of the federal energy regulatory commission 28 jurisdictional transmission services during that same period. - 2025 69th Legislature 2025 SB0301.2 - 5 - Authorized Print Version – SB 301 1 2 (c) (i) At the conclusion of each forecasted 12-month period, a public utility shall make a filing to 3 adjust for a recovery that is above or below the actual, prudently incurred costs and for any revenues the public 4 utility receives from providing federal energy regulatory commission jurisdictional services. 5 6 (ii) If the federal energy regulatory commission grants the recovery of costs in the rate base during 7 construction, the public utility may seek similar treatment of these costs through the optional ratemaking 8 procedures described in this section. 9 (3) Following the initial implementation of unbundled electric transmission rates and optional 10 ratemaking procedures, the commission shall: 11 12 (a) authorize the public utility to change the rates it charges that are associated with its provision of 13 electric transmission service on a schedule comparable to the schedule the public utility uses to change its 14 federal energy regulatory commission formula rates ; and 15 16 (b) authorize a change in the rates associated with the provision of electric transmission service 17 that is set to go into effect no later than 30 days from the date of filing on an interim basis .. 18 19 (4) A filing to change rates pursuant to this section must comply with the Montana Administrative 20 Procedure Act, Title 2, chapter 4, part 6. 21 (5) The commission may adopt rules for the implementation of this section." 22 23 NEW SECTION. Section 4. [Sections 1 through 3] are intended to be 24 codified as an integral part of Title 69, chapter 4, part 1, and the provisions of Title 69, chapter 4, part 1, apply 25 to [sections 1 through 3]. 26 27 NEW SECTION.
