Referred to: Education - K-12, if favorable, State and Local Government, if favorable, Rules, Calendar, and Operations of the House February 21, 2025 *H150 -v-1* A BILL TO BE ENTITLED 1 AN ACT TO ALLOW CERTAIN EDUCATIONAL ORGA NIZATIONS TO EXPEDITE THE 2 PROCESS TO OBTAIN SURPLUS AND DECOMMISSI ONED FEDERAL MATERIA L 3 AND PROPERTY. 4 The General Assembly of North Carolina enacts: 5 SECTION 1. Part 2 of Article 3A of Chapter 143 of the General Statutes is amended 6 by adding a new section to read: 7 "§ 143-64.5A. Certain educational institutions exempt. 8 Notwithstanding any provisions or limitations of Part 2 of this Article, an educational 9 organization is authorized and empowered to obtain decommissioned and surplus material and 10 property under contracts and agreements with the federal government or any of its departments 11 or agencies provided that the material and property is intended to be used for educational 12 purposes. To the extent set forth above and in this section, the provisions of Part 2 of this Article 13 shall not apply to an educational organization. For the purposes of this section, the term 14 "educational organization" means an organization that has education as its primary purpose and 15 that is a nonprofit organization, a not-for-profit organization, or an organization that has 16 tax-exempt status under 26 U.S.C. § 501(c)(3)." 17 SECTION 2. This act is effective when it becomes law. 18
