AN ACT TO ALLOW CERT AIN EDUCATIONAL ORGA NIZATIONS AND STATE 2 
AGENCIES TO EXPEDITE THE PROCESS TO OBTA IN SURPLUS AND 3 
DECOMMISSIONED FEDER AL MATERIAL AND PROP ERTY AND TO REQUIRE 4 
THAT CERTAIN FUNDS B E ALLOCATED TO THE D EPARTMENT OF 5 
ADMINISTRATION FOR A TWELFTH GRADE TRANS ITION PROGRAM FOR 6 
CERTAIN INDIAN EDUCATION STUDENTS. 7 
The General Assembly of North Carolina enacts: 8 
SECTION 1. Part 2 of Article 3A of Chapter 143 of the General Statutes is amended 9 
by adding the following new sections to read: 10 
"§ 143-64.5A.  Certain educational institutions exempt. 11 
Notwithstanding any provisions or limitations of Part 2 of this Article, an educational 12 
organization is authorized and empowered to obtain decommissioned and surplus material and 13 
property under contracts and agreements with the federal government or any of its departments 14 
or agencies provided that the material and property is intended to be used for educational 15 
purposes. For the purposes of this section, the term "educational organization" means an 16 
organization that has education as its primary purpose and that is a nonprofit organization, a 17 
not-for-profit organization, or an organization that has tax-exempt status under 26 U.S.C. § 18 
501(c)(3). 19 
"§ 143-64.5B.  Public safety exemption. 20 
Notwithstanding any provisions or limitations of Part 2 of this Article, any State agency is 21 
authorized and empowered to obtain decommissioned and surplus material and property under 22 
contracts and agreements with the federal government or any of its departments or agencies 23 
provided that the material and property is intended to promote public safety. For the purposes of 24 
this section, the term "State agency" means any board, bureau, commission, department, 25 
institution, or agency of the State." 26 
SECTION 2. Notwithstanding any provision of S.L. 2023-134 to the contrary, the 27 
sum of five million dollars ($5,000,000) in nonrecurring funds appropriated to the Department 28 
of Public Instruction to contract with MyScholar, LLC, shall instead be allocated to the 29 
Department of Administration for use by the Commission on Indian Affairs to contract with 30 
MyScholar, LLC, to support the ScholarPath platform in developing the Twelfth Grade 31 
Transition Program for Indian Education students in grades six through 12 to match students with 32 
pathways aligned with their career interests. 33 
SECTION 3. This act is effective when it becomes law. 34
