A BILL TO BE ENTITLED 1
AN ACT REPEALING THE LAW THAT AUTHORIZES COUNTIES TO FRANCHISE 2
AMBULANCE SERVICES AND PROVIDING THAT COUNTY OFFICIALS SHALL 3
NOT BE REQUIRED TO APPROVE MODIFICATIONS IN THE LEVEL OF CARE 4
PROVIDED BY EMS PROVIDERS THAT ARE NOT OWNED OR OPERATED BY A 5
CITY IN THE COUNTY OR THE COUNTY RESPONSIBLE FOR THE EMERGENCY 6
MANAGEMENT SYSTEM. 7
The General Assembly of North Carolina enacts: 8
SECTION 1. G.S. 153A-250 is repealed. 9
SECTION 2. Notwithstanding any provision of or any rule or regulation adopted 10
pursuant to the authority granted in G.S. 143-508(b), Article 7 of Chapter 131E of the General 11
Statutes, or any other provision of law, a county manager or EMS administrator delegated the 12
authority to act on behalf of the county shall not be required to sign a document or otherwise 13
approve of a modification in the level of care being provided by a provider within the county's 14
emergency management system. For purposes of this section, a "modification" means either an 15
increase or decrease in level of care. The provisions of this section do not apply if the provider 16
is a city located within the county or the county responsible for the emergency management 17
system. 18
SECTION 3. This act is effective when it becomes law. Section 2 of this act applies 19
to any modification in the level of care occurring on or after the date this act becomes law. 20
