AN ACT TO MODIFY THE CONFIDENTIALITY OF LEGISLATORS DOCUMENTS. 2
The General Assembly of North Carolina enacts: 3
SECTION 1. G.S. 120-135 reads as rewritten: 4
"ยง 120-135. Legislator is custodian of documents. 5
(a) Each legislator, while in office and after leaving office, shall be the custodian of all 6
documents, supporting documents, drafting requests, and information requests made or received 7
by that legislator while a legislator. 8
(b) A legislator, while in office or after leaving office, shall not be required to reveal or 9
to consent to reveal any document, supporting document, drafting request, or information request 10
made or received by that legislator while a legislator.legislator, except for with respect to the 11
following: 12
(1) Federal grand jury subpoenas. 13
(2) Requests for information from investigative authorities. 14
(3) Correspondence regarding bills appropriating State funds to businesses and 15
nonprofits. 16
(4) Correspondence with lobbyists and lobbyist principals regarding legislation. 17
(5) Compensation records of the legislator's staff. 18
(6) Correspondence with State agencies regarding business interests of the 19
legislator." 20
SECTION 2. This act is effective when it becomes law. 21
