AN ACT TO ALLOW THE MITCHELL COUNTY SHERIFF 'S OFFICE TO ENTER INTO 2
MEMORANDUMS OF UNDERSTANDING WITH THE UNICOI COUNTY, 3
TENNESSEE, SHERIFF'S OFFICE TO PERFORM LAW ENFORCEMENT SPECIAL 4
OPERATIONS MISSIONS ACROSS STATE LINES. 5
The General Assembly of North Carolina enacts: 6
SECTION 1.(a) Notwithstanding any provision of law to the contrary, the Mitchell 7
County Sheriff's Office may enter into memorandums of understanding with the Unicoi County, 8
Tennessee, Sheriff's Office to engage across state lines in law enforcement special operations 9
missions. 10
SECTION 1.(b) Any memorandum of understanding entered into pursuant to this 11
section shall specify the manner in which liability claims for damage to persons or property as a 12
result of law enforcement special operations missions will be shared or assigned. While ensuring 13
public safety, each memorandum of understanding shall limit to the greatest extent possible the 14
liability of Mitchell County and the State. 15
SECTION 2. No later than November 1 of each year, any memorandum of 16
understanding entered into that year pursuant to this act shall be reported to the Department of 17
Justice. 18
SECTION 3. This act is effective when it becomes law. 19
