A BILL TO BE ENTITLED 1
AN ACT TO ESTABLISH A CRIMINAL OFFENSE FOR POSSESSING ANY EXPLOSIVE 2
OR INCENDIARY DEVICE OR MATERIAL IF CIRCUMSTANCES INDICATE T HE 3
DEVICE OR MATERIAL WILL BE USED TO COMMIT A CRIME. 4
The General Assembly of North Carolina enacts: 5
SECTION 1. G.S. 14-49 reads as rewritten: 6
"§ 14-49. Malicious use of explosive or incendiary; punishment. 7
(a) Any person who possesses any explosive or incendiary device or material when the 8
circumstances indicate some probability that such device or material will be so used to violate 9
this section is guilty of a Class H felony. 10
(a1) Any person who willfully and maliciously injures another by the use of any explosive 11
or incendiary device or material is guilty of a Class D felony. 12

SECTION 2. This act becomes effective December 1, 2025, and applies to offenses 14
committed on or after that date. 15
