The following constitutes the reasons for this bill and the purposes which are sought to be
accomplished thereby:
LB21 adopts the Uniform Unlawful Restrictions in Land Records Act. While racially
restrictive covenants are illegal under state and federal law, and unenforceable under the
U.S. Constitution, many deeds still contain these illegal restrictions. The Uniform Unlawful
Restrictions in Land Records Act was approved by the Uniform Law Commission at their
annual meeting in July 2023, and provides a uniform means of amending and recording
an effective removal of an unlawful and unenforceable restriction on a deed while still
preserving the historical record.
