The following constitutes the reasons for this bill and the purposes which are sought to be
accomplished thereby:
LB247 is a bill being brought on behalf of the Nebraska Department of Environment and
Energy.
The bill would revise fees and the distribution of proceeds under the Integrated Solid Waste
Management Act. Specifically, the bill would add a provision that the fees collected under
section 13-2042 shall also be used for state expenses relating to cost share, operation,
and maintenance for remediation of superfund sites under the federal Comprehensive
Environmental Response, Compensation, and Liability Act of 1980, 42 U.S.C. 9601 et seq.
and adjust the fees and the distribution of proceeds accordingly.
LB247 would also eliminate a provision that permits the Legislature to transfer funds from
the Petroleum Release Remedial Action Cash Fund to the Superfund Cost Share Cash Fund.
