The following constitutes the reasons for this bill and the purposes which are sought to be
accomplished thereby:
LB 380 updates the managed care statute for all providers and reinforces the need to protect access to behavioral
health services by requiring:
-all Medicaid providers are paid the rates that were funded by the legislatures appropriations process;
-all Medicaid providers are part of a monthly electronic communications as to any changes in MCO contracts;
-parity between mental health/substance use treatment services and physical health services per federal law and
make public parity compliance reports;
-that the Medicaid Division require contractor compliance with federal and state laws, rules and regulations
covering mental health or substance use disorder services including EPSDT (early and periodic screening and
diagnostic and treatment services) of children and youth in Medicaid system; and
-MCO contractors to maintain an adequate provider network across the Nebraska and for the Medicaid Division
to specifically define network adequacy criteria and assess each MCOs compliance on an annual basis and
publicly post findings.
