The following constitutes the reasons for this bill and the purposes which are sought to be
accomplished thereby:
LB 394 is brought at the request of the Department of Agriculture to update provisions of the
Nebraska Weights and Measures Act.€€
The bill would update reference to publications of the National Conference on Weights and
Measures that are incorporated into the Act as standards governing the sale of products by
weight, measure or count, and the methodologies for inspecting and verifying accuracy of
scales, meters and other devices used in commercial transactions.€€
LB 394 would additionally establish a new schedule of fees for commercial scales, meters
and other measuring devices that support the Department of Agricultures inspection and
enforcement activities. The bill would eliminate an initial application fee for the permit
required to legally place a device into commercial service. Further, the bill would reclassify
an annual "inspection" fee as an annual device fee and would revise both a base-year and
statutory maximum annual device fee.€ The additional fee authority authorized by the bill
would facilitate transitioning the weights and measures program to a fully cash funded
activity.€€
