LB457 amends §71- 1908 to require the Department of Health and Human Services (DHHS) in consultation with the Nebras ka
Department of Education (NDE) to develop model policies relating to anaphylaxis for use in school districts & licensed child care
programs.
LB457 also:
• changes the provisions of the Child Care Licensing Act
• requires school districts to adopt a policy relating to anaphylaxis
• provides powers & duties to DHHS & NDE
• limits the out-of-pocket cost of medically necessary epinephrine injectors to a covered individual

Explanation of Estimate:
LB457 requires DHHS to collaborate with the NDE to develop a model policy on anaphylaxis for use in school
districts and licensed child care programs. As part of Title 92, Nebraska Administrative Code, Chapter 59 –
Regulations for School Health and Safety, all accredited and approved schools, and approved early childhood
education programs must adopt and implement an Emergency Response to Life Threatening Asthma or
Systemic Allergic Reactions Protocol and must maintain the equipment and medication necessary to
implement the protocol. Therefore, the development of a policy should come with no fiscal impact.
