The following constitutes the reasons for this bill and the purposes which are sought to be
accomplished thereby:
LB 508, known as the "Defend the Guard Act",  would require a Congressional declaration
of war before Nebraskas National Guardsmen and women could be deployed to active duty
combat on foreign soil.€€
It further requires the Governor to review current federal orders that have placed members
of the Nebraska National Guard into active combat to determine whether such orders are
compliant with the requirements of the bill, and to take any action necessary to return
members of Nebraskas National Guard to Nebraska.  Within 30 days of the reviews
completion, the Governor shall then submit a report to the Government, Military, and
Veterans Affairs Committee summarizing his or her review of federal orders and any action
taken in response to that review.
The bill does not prevent foreign deployments of the Guard for training purposes or
deployments within the United States.
