LB 51 adopts the National Crime Prevention and Privacy Compact, enabling the Nebraska State Patrol (NSP) to oversee the secure 
interstate exchange of criminal history records for noncriminal justice purposes while maintaining compliance with state laws on privacy 
and public access. 
 
NSP states that by joining the compact in this proposal, can eliminate the $13.25 FBI fee per applicant, savin	g approximately $178,200 
in Fiscal Year 2026 and $356,400 in Fiscal Year 2027. The agency states that while this won’t completely prevent future applicant fee 
increases, it will help minimize them as the Criminal Identification Unit works to address its operating deficit and depleting Cash Fund 
reserves.

Explanation of Estimate: 
By joining the compact as outlined in this proposal, the Agency will be able to eliminate the current FBI fees 
that it is charged per applicant ($13.25).  These fees have averaged just under $30,000 per month.  It is 
important to note that the Criminal Identification Unit is currently evaluating its fee structure, as the fees 
charged to applicants has not been increased in many years.  T	he unit has been operating at a deficit in recent 
years and has had to rely on C	ash Fund reserves, which will be depleted. While this may not entirely eliminate 
any applicant fee increases, the amount of the increase should be lessened. 
 
Savings in operational expenses as a result of the reduction in FBI fees are estimated at $178,200 and 
$356,400 in Fiscal Years 2026 and 2027, respectively. The savings for Fiscal Year 2026 are estimated to only 
be for 6 months, as some time will be required to implement the systems needed for the compact.

No fiscal impact. The Judicial Branch is closely involved with the Nebraska State Patrol (NSP)	regarding 
criminal history. There is a potenti al future impact if the 	NSP changes procedures or agreements based on this
