Summary of purpose and/or changes:
The bill adopts the National Crime Prevention and Privacy Compact (Compact). The Compact
implements the Interstate Identification Index (III), which facilitates the exchange of criminal
history records for noncriminal justice purposes among states and the federal government. An
example of “noncriminal justice purposes” is when a state agency needs to conduct background
checks to screen state employees or licensees. The Compact allows the state agency or other
authorized users to receive out-of-state records for a complete background check.
The Superintendent of Law Enforcement and Public Safety will administer the Compact, and the
Nebraska State Patrol will be the repository of criminal history record information. The bill also
gives the Nebraska State Patrol authority to adopt rules and procedures for exchanging criminal
history record information with other states and the federal government.
The bill provides that the Compact does not affect the Nebraska State Patrol's obligations or duties
