LB 634 adopts the Legislative Sunset Review Act. The Legislative Sunset Review Committee will be comprised of the chairperson of the Executive Board, the cha irperson of the Appropriations Committee, and five members of the Legislat ure chosen by the Executive Board. Members will be appointed as soon as possible after January 1, 2026. The committee shall create a schedule to perform sunset reviews, beginning in 2027. Each reviewable entity shall be scheduled for review every five years. Reviewable entities are defined as boards, councils, committees, task forces, commissions, funds, programs, and any other entity, body, or position. Prior to the legislative session when the review is scheduled, each reviewable entity shall submit a report to the Legislature containing performance measures and activity and three years of data for each measure, including the previous two years and projected results for the current fiscal year; an explanation of factors contributing to any failure to achieve legislative standards; promptness and effectiveness with which the entity disposes of complaints; the extent to which the public is encouraged to participate in rules making; compliance with requirements of state law and applicable rules for small and minority-owned businesses; statutory objectives intended for each program and activity and extent to which objectives have been achieved; the extent to which the jurisdiction of the entit y overlap or d uplicate other entities; an assessment of corrected deficiencies and implementation of recommendations; the process by which the entity measures quality and efficiency; compliance with public records requirements; recommendations for statutory or budgetary changes; effect of federal intervention or loss of federal funds; a list of committee relating to the entity; programs or functions of the entity performed without specific statutory authority; and other information requested by the Legislature. The com mittee and relevant standing committee shall review the entity, including examination of costs, evaluation of best pr actices and alternatives, evaluation of viability of privatization or another entity performing the functions, and an evaluation of costs and consequences of discontinuing the function. The committee shall review the report submitted, hold public hearings relating to the information, and present a report on the reviewable entities by December 15 of each year. The committee may make recommen dations related to each entity and propose legislation to carry out the recommendations. LB 634 also contains provisions related to bonds and obligations of reviewable entities in the event the entity is terminated. The bill outright repeals statute sections related to the Legislature’ s Planning Committee as well as the Nebraska Economic Development Task Force, which terminated in 2021. The bill includes reporting requirements for state agencies, which is estimated to be accommodated within their current appropriation levels. The Legislative Council estimates no fiscal impact.
