The following constitutes the reasons for this bill and the purposes which are sought to be
accomplished thereby:
LB663 establishes a clear and streamlined process for reviewing conditional use permits and special exception
applications. Upon receiving an application, the planning commission has 30 days to assess its completeness. If
the application is incomplete, the commission must notify the applicant within 10 days. €The process is then on
hold until the applicant submits the required information. €Once an application is deemed complete, the planning
commission must either approve, deny, or forward a recommendation to the county board within 90 days.
The county board then has 30 days from receiving the commissions recommendation to review the application.
If deemed incomplete, the board must notify the applicant within 10 days. Again, the €process is then on
hold until the applicant submits the required information.. The board must issue a decision within 90 days of
determining the application is complete.
Both the planning commission and county board will presume the applicant‚s compliance with all local, state,
and federal regulations unless evidence proves otherwise. If no such evidence is presented, the application
will be approved. The granting of a permit does not exempt the applicant from fulfilling other regulatory
requirements.
Additionally, each member of the planning commission and county board must complete two hours of education
per term on matters relevant to their role under this section. This education will be developed and presented by
the county attorney.
