A992 REYNOLDS-JACKSON, STANLEY 2 AN ACT authorizing the State Chief Diversity Officer to conduct a 1 disparity study concerning the utilization of minority-owned and 2 women-owned businesses in the State procurement process and 3 supplementing Title 52 of the Revised Statutes. 4 5 BE IT ENACTED by the Senate and General Assembly of the State 6 of New Jersey: 7 8 1. a. The Chief Diversity Officer shall conduct a study 9 concerning the utilization of minority-owned and women-owned 10 businesses in the procurement of goods and services for State agencies 11 to determine whether disparities exist in the availability and utilization 12 of minority-owned and women-owned businesses. 13 b. Within 18 months after the date of enactment of this act, the 14 Chief Diversity Officer shall prepare and submit to the Governor and, 15 pursuant to section 2 of P.L.1991, c.164 (C.52:14-19.1), to the 16 Legislature, a report containing the study’s findings and 17 recommendations for legislative or other actions that can be taken to 18 promote opportunities for minority-owned and women-owned business 19 enterprises in the procurement of goods and services for State 20 agencies. 21 c. The Chief Diversity Officer may prepare and submit additional 22 reports as the officer deems appropriate, and each report, with the 23 exception of the first report prepared under this section, shall 24 additionally identify the extent to which the officer’s prior 25 recommendations have been successfully implemented and the 26 apparent impact that the implementation of such recommended 27 changes have had on the procurement of goods and services for State 28 agencies in the preceding years. Every four years following the 29 issuance of the first report the officer shall report to the Legislature 30 whether a study concerning the utilization of minority-owned and 31 women-owned businesses in the procurement of goods and services 32 for State agencies is needed and may request an appropriation of 33 funding for the study to be included in the next following annual 34 appropriations act. 35 d. For purposes of this section, "State agency" means any of the 36 principal departments in the Executive Branch of the State 37 government, and any division, board, bureau, office, commission or 38 other instrumentality within or created by such department, the 39 Legislature of the State and any office, board, bureau or commission 40 within or created by the Legislative Branch, and any independent State 41 authority, commission, instrumentality or agency which is authorized 42 by law to award public contracts. 43 44 2. This act shall take effect immediately. 45
