                    ASSEMBLY EDUCATION COMMITTEE

STATEMENT TO

ASSEMBLY, No. 4381

with committee amendments

STATE OF NEW JERSEY

DATED: SEPTEMBER 19, 2024

The Assembly Education Committee reports favorably Assembly
Bill No. 4381 with committee amendments.
As amended, this bill adds federally qualified health centers to the
list of entities to which a local board of education may lease certain
school property for a nominal fee and without following the
competitive bidding process. The amended bill also provides that in
the event of joint occupancy with a public school and federally
qualified health center, to the extent permitted by federal law, a
federally qualified health center is to be located in a portion of the
school building that is separate and distinct from the portion of the
school building in which students may be present.
As amended and reported by the committee, Assembly Bill No.
4381 is identical to Senate Bill No. 3156, which was also amended and
reported by the committee on this date.

COMMITTEE AMENDMENTS :
The committee amended the bill to:
 make a technical amendment to clarify that leases for school
property to federally qualified health centers will be by private
agreement for a nominal fee without advertisement for bids,
the same as with other entities to which a board of education
may lease certain property; and
 require, in the event of joint occupancy with a public school
and federally qualified health center, to the extent permitted by
federal law, a federally qualified health center is to be located
in a portion of the school building that is separate and distinct
from the portion of the school building in which students may
be present.
