 The Assembly Transportation and Independent Authorities 
Committee reports favorably and with committee amendments 
Assembly Bill No. 5297. 
 As amended and reported, this bill prohibits a person from 
selling, leasing, renting, or otherwise distributing, or offering to 
sell, lease, rent, or otherwise distribute, a low-speed electric 
bicycle, low-speed electric scooter, motorized bicycle, motorized 
scooter, or motorized skateboard, or any lithium-ion or storage 
battery used to power such product, unless there is a red tag affixed 
to the charging cord of such product near the end that is plugged 
into the electricity source.  Under the bill, the tag is required to 
clearly and conspicuously state “UNPLUG WHEN NOT IN USE.”   
 In addition, the Division of Consumer Affairs (division) is 
required to post, on its Internet website, a model tag containing this 
warning so that any person selling, leasing, renting, or otherwise 
distributing a low-speed electric bicycle, low-speed electric scooter, 
motorized bicycle, motorized scooter, or motorized skateboard, or 
any lithium-ion or storage battery used to power such product, can 
affix the tag to the charging cord of such products.   
 
COMMITTEE AMENDMENTS : 
 The committee amended the bill to: 
 (1) remove the requirement for the red tag required under the 
bill to include additional information on consumer safety regarding 
safe usage of the product and its charging equipment; 
 (2) specify that the red tag required under the bill is to be 
affixed to the charging cord of the products listed in the bill near the 
end of the cord that is plugged into the electricity source; 
 (3) clarify that the division is to post the model tag required 
pursuant to the bill on the division’s Internet website; 
 (4) clarify that any person selling, leasing, renting, or otherwise 
distributing a low-speed electric bicycle, low-speed electric scooter, 
motorized bicycle, motorized scooter, or motorized skateboard, in 
addition to a lithium-ion or storage battery used to power such  2 
 
products, may affix the model tag on the charging cords of such 
products as required under the bill; 
 (5) provide that the bill is to become effective 180 days after 
enactment rather than immediately upon enactment; 
 (6) make technical corrections to the bill.
