STATEMENT TO [First Reprint] SENATE, No. 223 with Senate Floor Amendments (Proposed by Senator SMITH) ADOPTED: MARCH 24, 2025 These floor amendments: (1) require that any authorized third party that receives a customer's energy usage data be licensed by the Board of Public Utilities (BPU) pursuant to N.J.S.A 48:3-78, or demonstrate to the BPU that its cybersecurity and information security systems are at least as effective as those of entities that are licensed by the BPU; (2) authorize the BPU to require authorized third parties to submit data access plans; (3) allow existing data usage consent waivers (i.e., those which have already been signed by customers) to satisfy the bill's requirement that authorized third parties be provided with informed, written consent to receive a customer's energy usage data, provided that the BPU finds that the existing waiver satisfies the requirements of the bill; and (4) make technical changes.
