AN ACT
RELATING TO STATE EDUCATIONAL INSTITUTIONS; REQUIRING STATE
EDUCATIONAL INSTITUTIONS TO PROVIDE MENSTRUAL PRODUCTS IN
CAMPUS BATHROOMS; MAKING AN APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. A new section of Chapter 21, Article 1 NMSA
1978 is enacted to read:
"[NEW MATERIAL] FREE MENSTRUAL PRODUCTS IN STATE
EDUCATIONAL INSTITUTIONS.--
A.  As used in this section, "menstrual product"
means a sanitary pad or tampon.
B.  Menstrual products shall be provided at no
charge to students in each women's bathroom, each gender-
neutral bathroom and at least one men's bathroom in every state
educational institution enumerated in Article 12, Section 11 of

the constitution of New Mexico."
SECTION 2. APPROPRIATION.--One million dollars
($1,000,000) is appropriated from the general fund to the
higher education department for expenditure in fiscal year 2026
for disbursement to each state educational institution
enumerated in Article 12, Section 11 of the constitution of the
New Mexico based on the proportion of female students for the
purchase and installment of menstrual product dispensers and
the purchase and distribution of menstrual products to state
educational institutions statewide.  Any unexpended or
unencumbered balance remaining at the end of fiscal year 2026
shall revert to the general fund.
