AN ACT
RELATING TO STATE EDUCATIONAL INSTITUTIONS; REQUIRING ALL
MEMBERS OF THE BOARDS OF REGENTS OF STATE EDUCATIONAL
INSTITUTIONS AND THE GOVERNING BOARDS OF OTHER PUBLIC
POST-SECONDARY EDUCATIONAL INSTITUTIONS TO COMPLETE TEN HOURS
OF TRAINING; REQUIRING THE HIGHER EDUCATION DEPARTMENT TO
DEVELOP AND PROVIDE THE TRAINING AND MONITOR COMPLIANCE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1.  A new section of Chapter 21 NMSA 1978 is
enacted to read: 
"STATE EDUCATIONAL INSTITUTIONS--BOARDS OF REGENTS AND
GOVERNING BOARDS MANDATORY TRAINING.--
A.  The members of the boards of regents of all
state educational institutions enumerated in Article 12,
Section 11 of the constitution of New Mexico and the
governing boards of other public post-secondary educational
institutions shall complete ten hours of training during the
first six months of the members' terms.  The training shall
consist of:
(1)  two hours covering the provisions of the
constitution of New Mexico and state law pertaining to state
educational institutions and related post-secondary education
matters; 
(2)  two hours covering financial management, SEC/SB 19

budgeting and fiduciary duties;
(3)  two hours covering student success and
student support services;
(4)  two hours covering institutional
governance, innovation, best practices and available federal,
state and nongovernmental resources to assist the boards of
regents and members of the boards; and
(5)  two hours covering ethics and state law
regarding ethics oversight and public accountability,
including the Procurement Code, the Open Meetings Act, the
Gift Act and the Inspection of Public Records Act. 
B.  The higher education department shall: 
(1)  develop and provide the ten hours of
training to all members of the boards of regents and
governing boards; and
(2)  monitor and maintain a record of each
member's compliance with this section."
SECTION 2.  APPLICABILITY.--The provisions of this act
apply to all members appointed to the boards of regents of the
state educational institutions enumerated in Article 12,
Section 11 of the constitution of New Mexico and all members
of the governing boards of other public post-secondary
educational institutions after the effective date of this act
and to current members with at least one year of the members'
terms left to be served after the effective date of this act; SEC/SB 19

provided that current members to whom this act applies shall
complete the training no later than December 31, 2025.
