AN ACT relating to state employment; authorizing, under certain 
circumstances, an appointing authority to appoint without 
competition certain persons to fill a position in the 
classified service of the Executive Department of State 
Government; and providing other matters properly 
relating thereto. 
Legislative Counsel’s Digest: 
 Under existing law, a position in the classified service of the Executive 1 
Department of State Government may be filled without competition only under 2 
certain circumstances. (NRS 284.305) This bill sets forth an additional 3 
circumstance in which a position in the classified service may be filled without 4 
competition. Specifically, this bill authorizes a position in the classified service to 5 
be filled by a person without competition if the person: (1) meets the minimum 6 
qualifications for the position; and (2) has successfully completed at least 900 hours 7 
of service in an AmeriCorps program in this State not more than 2 years before the 8 
person applies for the position. 9

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  Chapter 284 of NRS is hereby amended by adding 1 
thereto a new section to read as follows: 2 
 An appointing authority may appoint a person to fill a position 3 
in the classified service without competition if the person: 4 
 1. Meets the minimum qualifications for the position; and 5 
 2. Has successfully completed at least 900 hours of service in 6 
an AmeriCorps program in this State not more than 2 years before 7 
the person applies for the position in the classified service. 8 
 Sec. 2.  NRS 284.305 is hereby amended to read as follows: 9 
 284.305 1.  Except as otherwise provided in subsection 2, 10 
positions in the classified service may be filled without competition 11 
only as provided in NRS 284.155, 284.300, 284.307, 284.309, 12 
284.310, 284.315, 284.320, 284.325, 284.327, 284.330, 284.375 and 13 
284.3775 [.] and section 1 of this act. 14 
 2.  The Commission may adopt regulations which provide for 15 
filling positions in the classified service without competition in 16 
cases involving: 17 
 (a) The appointment of a current employee with a disability to a 18 
position at or below the grade of his or her position if the employee 19 
becomes unable to perform the essential functions of his or her 20 
position with or without reasonable accommodation; 21 
 (b) The demotion of a current employee;  22 
 (c) The reemployment of a current or former employee who was 23 
or will be adversely affected by layoff, military service, 24 
reclassification or a permanent partial disability arising out of and in 25 
the course of the employment of the current or former employee; or 26 
 (d) The reappointment of a current employee. 27
