S.B. 91 - *SB91* SENATE BILL NO. 91–SENATOR LANGE PREFILED JANUARY 30, 2023 ____________ Referred to Committee on Commerce and Labor SUMMARY—Authorizes a licensed clinical alcohol and drug counselor to supervise a certified problem gambling counselor intern. AN ACT relating to alcohol, drug and gambling counselors; authorizing a licensed clinical alcohol and drug counselor who meets certain requirements to supervise a certified problem gambling counselor intern; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law authorizes a licensed clinical alcohol and drug counselor to 1 supervise certified clinical alcohol and drug counselor interns and alcohol and drug 2 counselor interns. (NRS 641C.331) Existing law authorizes the Board of Examiners 3 for Alcohol, Drug and Gambling Counselors to issue a certificate as a problem 4 gambling counselor to a person who has completed at least 2,000 hours of 5 supervised counseling of persons with an addictive disorder related to gambling and 6 meets certain other requirements. (NRS 641C.430) Existing law authorizes a 7 certified problem gambling counselor intern to counsel persons with an addictive 8 disorder related to gambling under the supervision of a certified problem gambling 9 counselor approved by the Board. (NRS 641C.435, 641C.440) Sections 1 and 2 of 10 this bill additionally authorize a licensed clinical alcohol and drug counselor who is 11 approved by the Board and has completed certain instruction concerning problem 12 gambling and the supervision of interns to supervise a certified problem gambling 13 counselor intern. 14 – 2 – - *SB91* THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 641C.331 is hereby amended to read as 1 follows: 2 641C.331 1. A license as a clinical alcohol and drug 3 counselor is valid for 2 years and may be renewed. 4 2. A licensed clinical alcohol and drug counselor may: 5 (a) Engage in the clinical practice of counseling persons with 6 alcohol and other substance use disorders; 7 (b) Diagnose or classify a person as having an alcohol or other 8 substance use disorder; [and] 9 (c) Supervise certified clinical alcohol and drug counselor 10 interns and alcohol and drug counselor interns [.] ; and 11 (d) Supervise certified problem gambling counselor interns if 12 the licensed clinical alcohol and drug counselor: 13 (1) Is approved by the Board to conduct such supervision; 14 and 15 (2) Has completed at least: 16 (I) Thirty hours of instruction relating to problem 17 gambling; and 18 (II) Twelve hours of instruction relating to the 19 supervision of interns, including, without limitation, the 20 supervision of certified problem gambling counselor interns. 21 Sec. 2. NRS 641C.440 is hereby amended to read as follows: 22 641C.440 1. The Board may issue a certificate as a problem 23 gambling counselor intern to a person who: 24 (a) Is not less than 21 years of age; 25 (b) Submits proof to the Board that the person: 26 (1) Has received a bachelor’s degree, master’s degree or a 27 doctoral degree from an accredited college or university in a field of 28 social science approved by the Board; or 29 (2) Is enrolled in a program at an accredited college or 30 university from which he or she will receive a bachelor’s degree, 31 master’s degree or a doctoral degree in a field of social science 32 approved by the Board; 33 (c) Has completed not less than 30 hours of training specific to 34 problem gambling approved by the Board; 35 (d) Demonstrates that a certified problem gambling counselor 36 approved by the Board or a licensed clinical alcohol and drug 37 counselor who meets the requirements of paragraph (d) of 38 subsection 2 of NRS 641C.331 has agreed to supervise him or her 39 in a setting approved by the Board; 40 (e) Pays the fees required pursuant to NRS 641C.470; and 41 – 3 – - *SB91* (f) Submits all information required to complete an application 1 for a certificate. 2 2. A certificate as a problem gambling counselor intern is valid 3 for 6 months and, except as otherwise provided in subsection 3, may 4 be renewed. 5 3. A certificate as a problem gambling counselor intern issued 6 to a person on the basis that the person is enrolled in a program at an 7 accredited college or university from which he or she will receive a 8 bachelor’s degree, master’s degree or a doctoral degree in a field of 9 social science approved by the Board may be renewed not more than 10 nine times. 11 4. A certified problem gambling counselor intern may, under 12 the supervision of a certified problem gambling counselor [:] or a 13 licensed clinical alcohol and drug counselor who meets the 14 requirements of paragraph (d) of subsection 2 of NRS 641C.331: 15 (a) Engage in the practice of counseling persons with an 16 addictive disorder related to gambling; and 17 (b) Assess and evaluate a person as having an addictive disorder 18 related to gambling. 19 Sec. 3. This act becomes effective on July 1, 2023. 20 H
