AN ACT relating to civil liability; providing immunity from civil liability to certain persons authorized to provide certain care pursuant to an agreement between a hospital and the Armed Forces of the United States; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law authorizes a hospital to enter into an agreement with the Armed 1 Forces of the United States for the provision of certain care under certain 2 circumstances. (NRS 449.2455) Under existing law, an immune contractor of the 3 State or any of its agencies or political subdivisions is immune from civil liability 4 for certain acts or omissions of the contractor. (NRS 41.032) This bill revises the 5 applicable definition of “immune contractor” to include any person authorized to 6 provide care pursuant to an agreement between a hospital and the Armed Forces of 7 the United States. This bill thereby makes a person authorized to provide care 8 pursuant to any such agreement immune from civil liability for certain acts or 9 omissions of the person. 10 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 41.0307 is hereby amended to read as follows: 1 41.0307 As used in NRS 41.0305 to 41.039, inclusive: 2 1. “Employee” includes an employee of a: 3 (a) Part-time or full-time board, commission or similar body of 4 the State or a political subdivision of the State which is created by 5 law. 6 (b) Charter school. 7 – 2 – - *AB253* (c) University school for profoundly gifted pupils described in 1 chapter 388C of NRS. 2 2. “Employment” includes any services performed by an 3 immune contractor. 4 3. “Immune contractor” means any [natural] : 5 (a) Natural person, professional corporation or professional 6 association which [: 7 (a) Is] is an independent contractor with the State pursuant to 8 NRS 333.700 [; and 9 (b) Contracts] and contracts to provide medical services for the 10 Department of Corrections. 11 [] As used in this [subsection,] paragraph, “professional 12 corporation” and “professional association” have the meanings 13 ascribed to them in NRS 89.020. 14 (b) Person authorized to provide care pursuant to an 15 agreement authorized by NRS 449.2455. 16 4. “Public officer” or “officer” includes: 17 (a) A member of a part-time or full-time board, commission or 18 similar body of the State or a political subdivision of the State which 19 is created by law. 20 (b) A public defender and any deputy or assistant attorney of a 21 public defender or an attorney appointed to defend a person for a 22 limited duration with limited jurisdiction. 23 (c) A district attorney and any deputy or assistant district 24 attorney or an attorney appointed to prosecute a person for a limited 25 duration with limited jurisdiction. 26 H
