AN ACT relating to Medicaid; requiring the Director of the Department of Health and Human Services to seek to establish certain rates of reimbursement under Medicaid for vagus nerve stimulation therapy devices and replacement parts for such a device; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law requires the Department of Health and Human Services to 1 administer the Medicaid program. (NRS 422.270) This bill requires the Director of 2 the Department to submit to the United States Secretary of Health and Human 3 Services a request to amend Medicaid to provide rates of reimbursement for a 4 vagus nerve stimulation therapy device or any replacement parts for such a device 5 that are greater than or equal to 82 percent of the cost of such a device or 6 replacement parts, as applicable. This bill also clarifies that such reimbursement 7 must be separate from and in addition to the rates of reimbursement for medical 8 care necessary for the implantation of such a device or the replacement of a part for 9 the device. 10 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. 1. On or before October 1, 2025, the Director of 1 the Department of Health and Human Services shall submit to the 2 United States Secretary of Health and Human Services a request to 3 include under Medicaid: 4 – 2 – - *AB284* (a) A rate of reimbursement for a vagus nerve stimulation 1 therapy device that is greater than or equal to 82 percent of the cost 2 of such a device; and 3 (b) A rate of reimbursement for any replacement part for a vagus 4 nerve stimulation therapy device that is greater than or equal to 82 5 percent of the cost of such a replacement part. 6 2. The rates of reimbursement established pursuant to 7 subsection 1 must be separate from and in addition to the rates of 8 reimbursement for the medical care necessary for implantation of a 9 vagus nerve stimulation therapy device or the replacement of a part 10 for such a device. 11 3. The request submitted pursuant to subsection 1 must be 12 supported using methods for determining rates of reimbursement 13 accepted by the Secretary. 14 Sec. 2.
