AN ACT relating to education; requiring the State Board of Education to approve at least two assessments which may be used to assess the literacy of pupils enrolled in an elementary school; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law requires the board of trustees of a school district or the governing 1 body of a charter school to prepare a plan to improve the literacy of pupils enrolled 2 in an elementary school. Such a plan must include procedures to assess the 3 proficiency of a pupil in reading during each grade level of elementary school, as is 4 determined to be necessary, by using assessments that have been approved by the 5 State Board of Education by regulation. (NRS 388.157) This bill requires the State 6 Board to approve by regulation at least two assessments which the board of trustees 7 of a school district or the governing body of a charter school may administer to 8 pupils to assess proficiency in reading. 9 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 388.157 is hereby amended to read as follows: 1 388.157 1. The board of trustees of each school district and 2 the governing body of each charter school shall prepare a plan to 3 improve the literacy of pupils enrolled in an elementary school. 4 Such a plan must include, without limitation: 5 (a) A program to provide intervention services and intensive 6 instruction to pupils who have been identified as deficient in the 7 – 2 – - *AB386* subject area of reading to ensure that those pupils achieve adequate 1 proficiency in the requisite reading skills and reading 2 comprehension skills necessary to perform at a level determined by 3 a statewide assessment to be within a level determined by the State 4 Board for a pupil enrolled in the same grade in which the pupil is 5 enrolled. Such a program must include, without limitation, regularly 6 scheduled reading sessions in small groups and specific instruction 7 designed to target any area of reading in which the pupil 8 demonstrates a deficiency, including, without limitation, 9 phonological and phonemic awareness, decoding skills, reading 10 fluency and vocabulary and reading comprehension strategies; 11 (b) Procedures for assessing a pupil’s proficiency in the subject 12 area of reading using valid and reliable standards-based assessments 13 that have been approved by the State Board by regulation during 14 each grade level of the elementary school at which the pupil is 15 enrolled as determined necessary; 16 (c) A program to improve the proficiency in reading of pupils 17 who are English learners; and 18 (d) Procedures for facilitating collaboration between licensed 19 teachers designated as literacy specialists and classroom teachers. 20 2. The State Board shall approve by regulation at least two 21 valid and reliable standards-based assessments that the board of 22 trustees of a school district or the governing body of a charter 23 school may choose from to assess a pupil’s proficiency in the 24 subject area of reading. 25 3. The board of trustees of each school district or the governing 26 body of a charter school, as applicable, shall: 27 (a) Submit its plan to the Department for approval on or before 28 the date prescribed by the Department on a form prescribed by the 29 Department; and 30 (b) Make such revisions to the plan as the Department 31 determines are necessary. 32 [3.] 4. The Department shall adopt regulations that prescribe 33 procedures for assessing the development across early learning 34 domains of a pupil enrolled in kindergarten within the first 45 days 35 of school in a school year. 36 Sec. 2.
