AN ACT relating to higher education; authorizing the Board of 
Regents of the University of Nevada to require each 
institution within the Nevada System of Higher Education 
to adopt an emergency response plan to address opioid-
related drug overdoses; and providing other matters 
properly relating thereto. 
Legislative Counsel’s Digest: 
 This bill authorizes the Board of Regents of the University of Nevada to require 1 
each institution within the Nevada System of Higher Education to adopt an 2 
emergency response plan to address opioid-related drug overdoses at the institution. 3 
This bill requires such an emergency response plan to include: (1) plans for 4 
providing education on opioid-related drug overdoses; and (2) procedures for the 5 
distribution and administration of opioid antagonists. This bill prohibits an 6 
institution from adopting a plan that requires a person to complete training in order 7 
to obtain or administer an opioid antagonist. This bill authorizes the Board of 8 
Regents to adopt a model emergency response plan to assist institutions in 9 
developing their own plans. 10 
 
 
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  Chapter 396 of NRS is hereby amended by adding 1 
thereto a new section to read as follows: 2 
 1. The Board of Regents may require each institution within 3 
the System to, in consultation with the Division of Public and 4

Behavioral Health of the Department of Health and Human 1 
Services, adopt an emergency response plan to address opioid-2 
related drug overdoses at the institution. Such an emergency 3 
response plan must include, without limitation: 4 
 (a) Plans for providing education on opioid-related drug 5 
overdoses; 6 
 (b) Measures to respond compassionately to opioid-related 7 
drug overdoses, including, without limitation: 8 
  (1) Emphasizing rescue breathing techniques; and  9 
  (2) Utilizing naloxone hydrochloride in a dosage of 4 10 
milligrams; and 11 
 (c) Procedures for the distribution and administration of 12 
opioid antagonists, including, without limitation, ensuring ease of 13 
access to opioid antagonists. 14 
 2. Each institution within the System may tailor the 15 
emergency response plan described in subsection 1 to meet the 16 
needs and capacity of the institution for implementing the plan. In 17 
tailoring an emergency response plan, an institution may 18 
determine: 19 
 (a) Whether training related to the plan will be provided in 20 
person or virtually and synchronously or asynchronously;  21 
 (b) The locations at the institution where opioid antagonists 22 
will be accessible; and  23 
 (c) The manner in which opioid antagonists will be distributed 24 
at the institution. 25 
 3. An emergency response plan described in subsection 1 may 26 
not require a person to complete any training in order to obtain or 27 
administer an opioid antagonist. 28 
 4. The Board of Regents may adopt a model emergency 29 
response plan that meets the requirements of this section to assist 30 
institutions in developing their emergency response plans 31 
pursuant to subsection 1. The Board of Regents may not require 32 
an institution to utilize the model emergency response plan. 33 
 5. As used in this section: 34 
 (a) “Opioid antagonist” has the meaning ascribed to it in  35 
NRS 453C.040. 36 
 (b) “Opioid-related drug overdose” has the meaning ascribed 37 
to it in NRS 453C.050. 38 
 Sec. 2.  This act becomes effective upon passage and approval. 39
