AN ACT relating to insurance; revising certain notice requirements 
imposed on an insurer who issues a policy of portable 
electronics insurance; and providing other matters 
properly relating thereto. 
Legislative Counsel’s Digest: 
 Existing law requires an insurer who issues a policy of portable electronics 1 
insurance to provide certain notices that are required to be provided to an enrolled 2 
customer, vendor or other policyholder to be: (1) mailed or delivered; or (2) sent by 3 
electronic mail or other electronic means in accordance with regulations adopted by 4 
the Commissioner of Insurance. (NRS 691D.330) Existing law requires any insurer 5 
to cease delivering any notice or other document by electronic means, and to use an 6 
alternative delivery method, if the insurer: (1) attempts to deliver a notice or other 7 
document by electronic means and has a reasonable basis to believe that the notice 8 
or other document was not received by the party; or (2) becomes aware that the 9 
electronic mail address provided by the party is no longer valid. (NRS 680A.560) 10 
 This bill eliminates the requirement that an insurer who issues a policy of 11 
portable electronics insurance and who sends certain notices by electronic mail or 12 
other electronic means do so in accordance with regulations adopted by the 13 
Commissioner. This bill additionally specifies that the requirements setting forth 14 
the circumstances under which an insurer is required to cease delivering a notice or 15 
document by electronic means applies to an insurer who issues a policy of portable 16 
electronics insurance. 17

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  NRS 691D.330 is hereby amended to read as 1 
follows: 2 
 691D.330 Notwithstanding any other provision of law: 3 
 1.  Except as otherwise provided in this section, an insurer that 4 
issues a policy of portable electronics insurance may not terminate 5 
the policy before the expiration of the agreed term of the policy 6 
unless, not less than 30 days before the effective date of the 7 
termination, the insurer provides notice to: 8 
 (a) The holder of the policy of portable electronics insurance; 9 
and 10 
 (b) If the policy is a group policy issued to a vendor under 11 
which individual customers may elect to enroll for coverage, each 12 
enrolled customer. 13 
 2.  If the insurer changes a term or condition of a policy of 14 
portable electronics insurance, the insurer shall, not less than 30 15 
days before the effective date of the change, provide: 16 
 (a) The policyholder with a revised policy or endorsement; and  17 
 (b) Each enrolled customer with a revised certificate of 18 
coverage, endorsement, brochure or other evidence of coverage 19 
which: 20 
  (1) Declares that the insurer has changed a term or condition 21 
of the policy which may affect the enrolled customer’s coverage; 22 
and 23 
  (2) Provides a summary of the material changes. 24 
 3.  An insurer may terminate an enrolled customer’s coverage 25 
under a vendor’s policy of portable electronics insurance upon the 26 
discovery of fraud or material misrepresentation by the enrolled 27 
customer in obtaining the coverage or in presenting a claim 28 
thereunder if the insurer provides notice of the termination to the 29 
vendor and the enrolled customer within 10 days after discovery of 30 
the fraud or material misrepresentation. 31 
 4.  An insurer may immediately terminate an enrolled 32 
customer’s coverage under a vendor’s policy of portable electronics 33 
insurance if the enrolled customer: 34 
 (a) Fails to pay a premium; 35 
 (b) Ceases to have an active service with the vendor; or 36 
 (c) Exhausts the aggregate limit of liability, if any, under the 37 
terms of the policy of portable electronics insurance and the insurer 38 
provides notice of termination to the customer within 30 calendar 39 
days after exhaustion of the limit. If the insurer fails to provide 40 
timely notice as required by this paragraph, the enrolled customer’s 41 
coverage under the policy continues until the insurer provides notice 42

of termination to the enrolled customer notwithstanding the 1 
exhaustion of the aggregate limit of liability. 2 
 5.  A vendor or other holder of a group policy of portable 3 
electronics insurance shall not terminate the policy unless, not less 4 
than 30 days before the effective date of the termination, the insurer 5 
provides notice to each enrolled customer of the termination of the 6 
policy and the effective date of termination. An insurer may 7 
authorize a vendor to provide notice to an enrolled customer on 8 
behalf of the insurer pursuant to this subsection. 9 
 6.  Any notice that is required pursuant to this section must be 10 
in writing and be: 11 
 (a) Mailed or delivered to the enrolled customer, vendor or other 12 
policyholder at his or her last known address; or 13 
 (b) [Sent] Except as otherwise provided in NRS 680A.560, sent 14 
by electronic mail or other electronic means [in accordance with 15 
regulations adopted by the Commissioner] to the enrolled customer, 16 
vendor or other policyholder at the electronic mail address of the 17 
enrolled customer, vendor or other policyholder last known by the 18 
insurer. 19 
 An insurer or vendor who provides notice pursuant to this 20 
subsection must maintain proof of mailing or delivery in a form 21 
authorized or accepted by the United States Postal Service or other 22 
commercial mail delivery service or an electronic record or other 23 
proof that the notice was sent. 24
