AN ACT making an appropriation to the Records, Communications and Compliance Division of the Department of Public Safety for carrying out a forensic DNA testing program; and providing other matters properly relating thereto. THE PEOPLE OF THE STATE OF NEVA DA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. 1. There is hereby appropriated from the State 1 General Fund to the Records, Communications and Compliance 2 Division of the Department of Public Safety the sum of $500,000 3 for carrying out a forensic DNA testing program. 4 2. Money appropriated by subsection 1 may be: 5 (a) Granted to a forensic laboratory designated by a board of 6 county commissioners to carry out the program. 7 (b) Used only: 8 (1) To conduct genetic marker analyses for unidentified 9 deceased persons; and 10 (2) If the DNA profile resulting from the genetic marker 11 analysis fails to yield a match in CODIS, for forensic genetic 12 genealogy DNA testing. 13 3. Any remaining balance of the appropriation made by 14 subsection 1 must not be committed for expenditure after June 30, 15 2027, by the entity to which the appropriation is made or any entity 16 to which money from the appropriation is granted or otherwise 17 transferred in any manner, and any portion of the appropriated 18 – 2 – - *AB473* money remaining must not be spent for any purpose after 1 September 17, 2027, by either the entity to which the money was 2 appropriated or the entity to which the money was subsequently 3 granted or transferred, and must be reverted to the State General 4 Fund on or before September 17, 2027. 5 4. As used in this section: 6 (a) “Biological specimen” means a biological sample, tissue, 7 fluid or other bodily sample suitable for genetic marker analysis, 8 obtained from a person. 9 (b) “CODIS” means the Federal Bureau of Investigation’s 10 Combined DNA Index System that allows for the storage and 11 exchange of DNA records submitted by federal, state and local 12 forensic DNA laboratories. 13 (c) “DNA” means deoxyribonucleic acid, which is located in the 14 cells of a person and which provides the genetic blueprint of a 15 person. 16 (d) “DNA profile” means the genetic constitution of a person at 17 defined locations in the DNA of the person. 18 (e) “Forensic genetic genealogy DNA testing” means any testing 19 performed in a forensic laboratory capable of producing a forensic 20 genealogy profile with a minimum of 100,000 genetic markers and 21 compatible with multiple genealogical databases consented for law 22 enforcement use and includes associated genealogical research. 23 (f) “Genetic marker analysis” means the analytical testing 24 process of a biological specimen that results in a DNA profile. 25 Sec. 2.
