AN ACT relating to insurance; revising provisions relating to reimbursement for certain treatment and services provided by certain providers of health care; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law entitles an insured to reimbursement for treatment by a 1 chiropractic physician if a policy of individual health insurance, policy of group 2 and blanket health insurance, nonprofit corporation contract for hospital, medical 3 and dental services or evidence of coverage of a health maintenance organization 4 provides coverage for treatment of an illness which is within the authorized scope 5 of practice of a qualified chiropractic physician. Existing law also contains similar 6 provisions applicable to: (1) a person who performs acupuncture; (2) a licensed 7 psychologist; (3) a licensed marriage and family therapist or licensed clinical 8 professional counselor; (4) a licensed associate in social work, social worker, 9 master social worker, independent social worker or clinical social worker; (5) a 10 licensed podiatrist; (6) a licensed clinical drug and alcohol counselor; and (7) 11 certain registered nurses under certain circumstances. (NRS 608.1575, 689A.0475-12 689A.0495, 689B.038-689B.0397, 689B.045, 689B.049, 695B.1951-695B.199, 13 695C.1765-695C.179) Sections 1-33 of this bill revise those provisions to instead 14 require that the provider who provided treatment to the insured is the person who is 15 entitled to reimbursement for the treatment provided. 16 – 2 – - *AB511* THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 689A.0475 is hereby amended to read as 1 follows: 2 689A.0475 If any policy of health insurance provides coverage 3 for acupuncture performed by a physician, [the insured is entitled to 4 reimbursement for acupuncture performed by] a person who is 5 licensed pursuant to chapter 634A of NRS [.] and performs 6 acupuncture on the insured is entitled to reimbursement for the 7 acupuncture performed. 8 Sec. 2. NRS 689A.048 is hereby amended to read as follows: 9 689A.048 If any policy of health insurance provides coverage 10 for treatment [of an illness] which is within the authorized scope of 11 the practice of a qualified psychologist, [the insured is entitled to 12 reimbursement for treatments by] a licensed psychologist [.] who 13 provides such treatment to the insured is entitled to reimbursement 14 for the treatment provided. 15 Sec. 3. NRS 689A.0483 is hereby amended to read as follows: 16 689A.0483 If any policy of health insurance provides coverage 17 for treatment [of an illness] which is within the authorized scope of 18 practice of a licensed marriage and family therapist or licensed 19 clinical professional counselor, [the insured is entitled to 20 reimbursement for treatment by] a marriage and family therapist or 21 clinical professional counselor who is licensed pursuant to chapter 22 641A of NRS [.] and who provides such treatment to the insured is 23 entitled to reimbursement for the treatment provided. 24 Sec. 4. NRS 689A.0485 is hereby amended to read as follows: 25 689A.0485 If any policy of health insurance provides coverage 26 for treatment [of an illness] which is within the authorized scope of 27 the practice of a licensed associate in social work, a social worker, a 28 master social worker, an independent social worker or a clinical 29 social worker, [the insured is entitled to reimbursement for 30 treatment by] an associate in social work, a social worker, a master 31 social worker, an independent social worker or a clinical social 32 worker who is licensed pursuant to chapter 641B of NRS [.] and 33 who provides such treatment to the insured is entitled to 34 reimbursement for the treatment provided. 35 Sec. 5. NRS 689A.0487 is hereby amended to read as follows: 36 689A.0487 1. If any policy of health insurance provides 37 coverage for treatment [of an illness] which is within the authorized 38 scope of practice of a qualified podiatrist, [the insured is entitled to 39 reimbursement for treatments by] a podiatrist who is licensed 40 pursuant to chapter 635 of NRS [.] and who provides such 41 – 3 – - *AB511* treatment to the insured is entitled to reimbursement for the 1 treatment provided. 2 2. The terms of the policy must not limit: 3 (a) Coverage for treatments by a podiatrist to a number less than 4 for treatments by other physicians. 5 (b) Reimbursement for treatments by a podiatrist to an amount 6 less than that reimbursed for similar treatments by other physicians. 7 Sec. 6. NRS 689A.049 is hereby amended to read as follows: 8 689A.049 1. If any policy of health insurance provides 9 coverage for treatment [of an illness] which is within the authorized 10 scope of practice of a qualified chiropractic physician, [the insured 11 is entitled to reimbursement for treatments by] a chiropractic 12 physician who is licensed pursuant to chapter 634 of NRS [.] and 13 who provides such treatment to the insured is entitled to 14 reimbursement for the treatment provided. 15 2. The terms of the policy must not limit: 16 (a) Coverage for treatments by a chiropractic physician to a 17 number less than for treatments by other physicians. 18 (b) Reimbursement for treatments by a chiropractic physician to 19 an amount less than that reimbursed for similar treatments by other 20 physicians. 21 Sec. 7. NRS 689A.0493 is hereby amended to read as follows: 22 689A.0493 If any policy of health insurance provides coverage 23 for treatment [of an illness] which is within the authorized scope of 24 practice of a licensed clinical alcohol and drug counselor, [the 25 insured is entitled to reimbursement for treatment by] a clinical 26 alcohol and drug counselor who is licensed pursuant to chapter 27 641C of NRS [unless] and who provides such treatment to the 28 insured is entitled to reimbursement for the treatment provided, 29 including, without limitation, if the clinical alcohol and drug 30 counselor must be directly reimbursed pursuant to: 31 1. An assignment of benefits described in NRS 687B.409; or 32 2. Any other applicable assignment of benefits. 33 Sec. 8. NRS 689A.0495 is hereby amended to read as follows: 34 689A.0495 1. If any policy of health insurance provides 35 coverage for services which are within the authorized scope of 36 practice of a registered nurse who is authorized pursuant to chapter 37 632 of NRS to perform additional acts in an emergency or under 38 other special conditions as prescribed by the State Board of Nursing, 39 and which are reimbursed when provided by another provider of 40 health care, [the insured is entitled to reimbursement for services 41 provided by such] a registered nurse [.] who provides such services 42 to the insured is entitled to reimbursement for the services 43 provided. 44 2. The terms of the policy must not limit: 45 – 4 – - *AB511* (a) Coverage for services provided by such a registered nurse to 1 a number of occasions less than for services provided by another 2 provider of health care. 3 (b) Reimbursement for services provided by such a registered 4 nurse to an amount less than that reimbursed for similar services 5 provided by another provider of health care. 6 3. An insurer is not required to pay for services provided by 7 such a registered nurse which duplicate services provided by another 8 provider of health care. 9 Sec. 9. NRS 689B.038 is hereby amended to read as follows: 10 689B.038 If any policy of group health insurance provides 11 coverage for treatment [of an illness] which is within the authorized 12 scope of the practice of a qualified psychologist, [the insured is 13 entitled to reimbursement for treatment by] a licensed psychologist 14 [.] who provides such treatment to the insured is entitled to 15 reimbursement for the treatment provided. 16 Sec. 10. NRS 689B.0383 is hereby amended to read as 17 follows: 18 689B.0383 If any policy of group health insurance provides 19 coverage for treatment [of an illness] which is within the authorized 20 scope of practice of a licensed marriage and family therapist or 21 licensed clinical professional counselor, [the insured is entitled to 22 reimbursement for treatment by] a marriage and family therapist or 23 clinical professional counselor who is licensed pursuant to chapter 24 641A of NRS [.] and who provides such treatment to the insured is 25 entitled to reimbursement for the treatment provided. 26 Sec. 11. NRS 689B.0393 is hereby amended to read as 9 follows: 10 689B.0393 1. If any group policy of health insurance 11 provides coverage for treatment [of an illness] which is within the 12 authorized scope of practice of a qualified podiatrist, [the insured is 13 entitled to reimbursement for treatments by] a podiatrist who is 14 licensed pursuant to chapter 635 of NRS [.] and who provides such 15 treatment to the insured is entitled to reimbursement for the 16 treatment provided. 17 2. An insurer is not required to pay for services provided by 10 such a registered nurse which duplicate services provided by another 11 provider of health care. 12 Sec. 16. NRS 689B.049 is hereby amended to read as follows: 13 689B.049 If any policy of group health insurance provides 14 coverage for acupuncture performed by a physician, [the insured is 15 entitled to reimbursement for acupuncture performed by] a person 16 who is licensed pursuant to chapter 634A of NRS [.] and performs 17 acupuncture on the insured is entitled to reimbursement for the 18 acupuncture performed. 19 Sec. 17. NRS 695B.1951 is hereby amended to read as 20 follows: 21 695B.1951 1. If any contract for hospital or medical services 22 provides coverage for treatment [of an illness] which is within the 23 authorized scope of practice of a qualified podiatrist, [the insured is 24 entitled to reimbursement for treatments by] a podiatrist who is 25 licensed pursuant to chapter 635 of NRS [.] and who provides such 26 treatment to the insured is entitled to reimbursement for the 27 treatment provided. 28 2. The terms of the policy must not limit: 29 (a) Coverage for treatments by a podiatrist to a number less than 30 for treatments by other physicians. 31 (b) Reimbursement for treatments by a podiatrist to an amount 32 less than that reimbursed for similar treatments by other physicians. 33 Sec. 18. NRS 695B.1955 is hereby amended to read as 34 follows: 35 695B.1955 If any contract for hospital or medical service 36 provides coverage for treatment [of an illness] which is within the 37 authorized scope of practice of a licensed clinical alcohol and drug 38 counselor, [the insured is entitled to reimbursement for treatment 39 by] a clinical alcohol and drug counselor who is licensed pursuant to 40 chapter 641C of NRS [unless] and who provides such treatment to 41 the insured is entitled to reimbursement for the treatment 42 provided, including, without limitation, if the clinical alcohol and 43 drug counselor must be directly reimbursed pursuant to: 44 1. An assignment of benefits described in NRS 687B.409; or 45 – 7 – - *AB511* 2. Any other applicable assignment of benefits. 1 Sec. 19. NRS 695B.196 is hereby amended to read as follows: 2 695B.196 If any contract for hospital or medical services 3 provides coverage for acupuncture performed by a physician, [the 4 insured is entitled to reimbursement for acupuncture performed by] 5 a person who is licensed pursuant to chapter 634A of NRS [.] and 6 performs acupuncture on the insured is entitled to reimbursement 7 for the acupuncture performed. 8 Sec. 20. NRS 695B.197 is hereby amended to read as follows: 9 695B.197 If any contract for hospital or medical service 10 provides coverage for treatment [of an illness] which is within the 11 authorized scope of the practice of a qualified psychologist, [the 12 insured is entitled to reimbursement for treatments by] a licensed 13 psychologist [.] who provides such treatment to the insured is 14 entitled to reimbursement for the treatment provided. 15 Sec. 21. NRS 695B.1973 is hereby amended to read as 16 follows: 17 695B.1973 If any contract for hospital or medical service 18 provides coverage for treatment [of an illness] which is within the 19 authorized scope of practice of a licensed marriage and family 20 therapist or licensed clinical professional counselor, [the insured is 21 entitled to reimbursement for treatment by] a marriage and family 22 therapist or clinical professional counselor who is licensed pursuant 23 to chapter 641A of NRS [.] and who provides such treatment to the 24 insured is entitled to reimbursement for the treatment provided. 25 Sec. 22. NRS 695B.1975 is hereby amended to read as 26 follows: 27 695B.1975 If any contract for hospital or medical service 28 provides coverage for treatment [of an illness] which is within the 29 authorized scope of the practice of a licensed associate in social 30 work, social worker, master social worker, independent social 31 worker or clinical social worker, [the insured is entitled to 32 reimbursement for treatment by] an associate in social work, social 33 worker, master social worker, independent social worker or clinical 34 social worker who is licensed pursuant to chapter 641B of NRS [.] 35 and who provides such treatment to the insured is entitled to 36 reimbursement for the treatment provided. 37 Sec. 23. NRS 695B.198 is hereby amended to read as follows: 38 695B.198 1. If any contract for hospital or medical service 39 provides coverage for treatment [of an illness] which is within the 40 authorized scope of practice of a qualified chiropractic physician, 41 [the insured is entitled to reimbursement for treatments by] a 42 chiropractic physician who is licensed pursuant to chapter 634 of 43 NRS [.] and who provides such treatment to the insured is entitled 44 to reimbursement for the treatment provided. 45 – 8 – - *AB511* 2. NRS 695B.199 is hereby amended to read as follows: 7 695B.199 1. If any contract for medical service provides 8 coverage for services which are within the authorized scope of 9 practice of a registered nurse who is authorized pursuant to chapter 10 632 of NRS to perform additional acts in an emergency or under 11 other special conditions as prescribed by the State Board of Nursing, 12 and which are reimbursed when provided by another provider of 13 health care, [the insured is entitled to reimbursement for services 14 provided by such] a registered nurse [.] who provides such services 15 to the insured is entitled to reimbursement for the services 16 provided. 17 2. The terms of the contract must not limit: 18 (a) Coverage for services provided by such a registered nurse to 19 a number of occasions less than for services provided by another 20 provider of health care. 21 (b) Reimbursement for services provided by such a registered 22 nurse to an amount less than that reimbursed for similar services 23 provided by another provider of health care. 24 3. An insurer is not required to pay for services provided by 25 such a registered nurse which duplicate services provided by another 26 provider of health care. 27 Sec. 25. NRS 695C.1765 is hereby amended to read as 28 follows: 29 695C.1765 If any evidence of coverage provides coverage for 30 acupuncture performed by a physician, [the insured is entitled to 31 reimbursement for acupuncture performed by] a person who is 32 licensed pursuant to chapter 634A of NRS [.] and performs 33 acupuncture on the insured is entitled to reimbursement for the 34 acupuncture performed. 35 Sec. 26. NRS 695C.177 is hereby amended to read as follows: 36 695C.177 If any evidence of coverage provides coverage for 37 treatment [of an illness] which is within the authorized scope of the 38 practice of a qualified psychologist, [the insured is entitled to 39 reimbursement for treatments by] a licensed psychologist [.] who 40 provides such treatment to the insured is entitled to reimbursement 41 for the treatment provided. 42 – 9 – - *AB511* Sec. 27. NRS 695C.1773 is hereby amended to read as 1 follows: 2 695C.1773 If any evidence of coverage provides coverage for 3 treatment [of an illness] which is within the authorized scope of 4 practice of a licensed marriage and family therapist or licensed 5 clinical professional counselor, [the insured is entitled to 6 reimbursement for treatment by] a marriage and family therapist or 7 clinical professional counselor who is licensed pursuant to chapter 8 641A of NRS [.] and who provides such treatment to the insured is 9 entitled to reimbursement for the treatment provided. 10 Sec. 28. NRS 695C.1789 is hereby amended to read as 6 follows: 7 695C.1789 If any evidence of coverage provides coverage for 8 treatment [of an illness] which is within the authorized scope of 9 practice of a licensed clinical alcohol and drug counselor, [the 10 insured is entitled to reimbursement for treatment by] a clinical 11 alcohol and drug counselor who is licensed pursuant to chapter 12 641C of NRS [unless] and who provides such treatment to the 13 insured is entitled to reimbursement for the treatment provided, 14 including, without limitation, if the clinical alcohol and drug 15 counselor must be directly reimbursed pursuant to: 16 1. If any evidence of coverage provides coverage 20 for services which are within the authorized scope of practice of a 21 registered nurse who is authorized pursuant to chapter 632 of NRS 22 to perform additional acts in an emergency or under other special 23 conditions as prescribed by the State Board of Nursing, and which 24 are reimbursed when provided by another provider of health care, 25 [the insured is entitled to reimbursement for services provided by 26 such] a registered nurse [.] who provides such services to the 27 insured is entitled to reimbursement for the services provided. 28 2. The terms of the evidence of coverage must not limit: 29 (a) Coverage for services provided by such a registered nurse to 30 a number of occasions less than for services provided by another 31 provider of health care. 32 (b) Reimbursement for services provided by such a registered 33 nurse to an amount less than that reimbursed for similar services 34 provided by another provider of health care. 35 3. An insurer is not required to pay for services provided by 36 such a registered nurse which duplicate services provided by another 37 provider of health care. 38 Sec. 33. NRS 608.1575 is hereby amended to read as follows: 39 608.1575 1. If an employer provides health benefits for his or 40 her employees which include coverage for services which are within 41 the authorized scope of practice of a registered nurse who is 42 authorized pursuant to chapter 632 of NRS to perform additional 43 acts in an emergency or under other special conditions as prescribed 44 by the State Board of Nursing, and which are reimbursed when 45 – 11 – - *AB511* provided by another provider of health care, [the employees are 1 entitled to reimbursement for services provided by such] a registered 2 nurse [.] who provides such services to an employee is entitled to 3 reimbursement for the services provided. 4 2. The benefits provided by the employer must not limit: 5 (a) Coverage for services provided by such a registered nurse to 6 a number of occasions less than for services provided by another 7 provider of health care. 8 (b) Reimbursement for services provided by such a registered 9 nurse to an amount less than that reimbursed for similar services 10 provided by another provider of health care. 11 3. The employer is not required to pay for services provided by 12 such a registered nurse which duplicate services provided by another 13 provider of health care. 14 Sec. 34.
