AN ACT relating to fetal alcohol spectrum disorders; establishing 
the Fetal Alcohol Spectrum Disorder Treatment 
Assistance Program within the Aging and Disability 
Services Division of the Department of Health and 
Human Services; and providing other matters properly 
relating thereto. 
Legislative Counsel’s Digest: 
 Existing law establishes the Autism Treatment Assistance Program within the 1 
Aging and Disability Services Division of the Department of Health and Human 2 
Services to serve as the primary autism program within the Department and to 3 
provide and coordinate services to persons diagnosed or determined to have autism 4 
spectrum disorders through the age of 19 years. (NRS 427A.875) Assembly Bill 5 
No. 422 of the 2023 Legislative Session (A.B. 422) required the Division, to the 6 
extent that money was available, to create a pilot program to serve children 7 
diagnosed with a fetal alcohol spectrum disorder. A.B. 422 required the pilot 8 
program to be administered by the Autism Treatment Assistance Program. (Chapter 9 
492, Statutes of Nevada 2023, at page 3021) 10 
 This bill establishes the Fetal Alcohol Spectrum Disorder Treatment Assistance 11 
Program, which is to be administered by the Autism Treatment Assistance 12 
Program, to provide and coordinate the provision of services to persons diagnosed 13 
or determined to have fetal alcohol spectrum disorders through the age of 13 years. 14

This bill authorizes the Fetal Alcohol Spectrum Disorder Treatment Assistance 15 
Program, to the extent that money is available, to take certain actions to facilitate 16 
the treatment of fetal alcohol spectrum disorders. 17 
 
 
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  Chapter 427A of NRS is hereby amended by 1 
adding thereto a new section to read as follows: 2 
 1. There is hereby established the Fetal Alcohol Spectrum 3 
Disorder Treatment Assistance Program within the Division to 4 
serve as the primary program within the Department for persons 5 
with a fetal alcohol spectrum disorder and to provide and 6 
coordinate the provision of services to persons diagnosed or 7 
determined, including, without limitation, through the use of a 8 
standardized assessment, to have fetal alcohol spectrum disorders 9 
through the age of 13 years. The Fetal Alcohol Spectrum Disorder 10 
Treatment Assistance Program must be administered by the 11 
Autism Treatment Assistance Program created by NRS 427A.875. 12 
 2. To the extent that money is available, the Fetal Alcohol 13 
Spectrum Disorder Treatment Assistance Program may: 14 
 (a) Prescribe an application process for parents and guardians 15 
of persons with fetal alcohol spectrum disorders described in 16 
subsection 1 to participate in the Program. 17 
 (b) Provide for the development of a plan of treatment for 18 
persons who participate in the Program. 19 
 (c) Promote the use of evidence-based treatments which are 20 
cost effective and have been proven to improve treatment of fetal 21 
alcohol spectrum disorders. 22 
 (d) Educate parents and guardians of persons with fetal 23 
alcohol spectrum disorders on fetal alcohol spectrum disorders 24 
and the assistance that may be provided by the parent or guardian 25 
to improve treatment outcomes. 26 
 (e) Establish and use a system for assessing persons with fetal 27 
alcohol spectrum disorders to determine a baseline to measure the 28 
progress of and prepare a plan for the treatment of such persons. 29 
 (f) Assist parents and guardians of persons with fetal alcohol 30 
spectrum disorders in obtaining public services that are available 31 
for the treatment of fetal alcohol spectrum disorders. 32 
 3. As used in this section, “fetal alcohol spectrum disorder” 33 
has the meaning ascribed to it in NRS 432B.0655. 34 
 Sec. 2.  This act becomes effective upon passage and approval. 35
