AN ACT relating to vessels; prohibiting the operation of a vessel in 
excess of a certain speed within 600 feet of the shoreline 
of Lake Tahoe; revising provisions relating to the 
violation of certain provisions of the Code of Ordinances 
of the Tahoe Regional Planning Agency; providing a 
penalty; and providing other matters properly relating 
thereto. 
Legislative Counsel’s Digest: 
 Under existing law, it is a misdemeanor to operate a vessel or permit a vessel to 1 
be operated at a speed in excess of 5 nautical miles per hour within 100 feet of a 2 
person who is bathing, wading, diving, floating or swimming and within 200 feet 3 
of: (1) any beach frequented by persons who are bathing, wading, diving, floating 4 
or swimming; (2) a swimming float, diving platform or lifeline; and (3) certain way 5 
or landing floats. (NRS 488.600) Section 1 of this bill makes it a misdemeanor to 6 
operate a vessel or permit a vessel to be operated at a speed in excess of 5 nautical 7 
miles per hour within 600 feet of the shoreline of Lake Tahoe. 8 
 Under existing law, certain peace officers are authorized to take various actions 9 
when a person violates certain sections of the Code of Ordinances of the Tahoe 10 
Regional Planning Agency. (NRS 277.215) Section 2 of this bill replaces 11 
references to ordinances no longer in effect with the current ordinances. 12

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  NRS 488.600 is hereby amended to read as follows: 1 
 488.600 Every owner, operator or person in command of any 2 
vessel is guilty of a misdemeanor who operates it or permits it to be 3 
operated at a speed in excess of 5 nautical miles per hour in any of 4 
the following areas: 5 
 1.  Within 100 feet of any person who is engaged in the act of 6 
bathing, wading, diving, floating or swimming. 7 
 2.  Within 200 feet of any: 8 
 (a) Beach frequented by persons who engage in the acts of 9 
bathing, wading, diving, floating or swimming. 10 
 (b) Swimming float, diving platform or lifeline. 11 
 (c) Way or landing float to which vessels are made fast or which 12 
is used for the embarkation or discharge of passengers. 13 
 3. Within 600 feet of the shoreline of Lake Tahoe. 14 
 Sec. 2.  NRS 277.215 is hereby amended to read as follows: 15 
 277.215 1.  Except as otherwise provided in subsection 3, 16 
every game warden, sheriff and other peace officer of this state and 17 
its political subdivisions may issue one or more of the following: 18 
 (a) Educational material provided by the Tahoe Regional 19 
Planning Agency; 20 
 (b) An oral advisory; or 21 
 (c) A warning citation, 22 
 to a person who violates, within the portion of the region that is 23 
within the waters of this state, section [54.16(A), 54.16(B)] 24 
60.1.3(E) or [81.2(E)] 84.10 of the Code of Ordinances adopted by 25 
the Tahoe Regional Planning Agency and in effect on [April 1, 26 
1999.] August 25, 2024. 27 
 2.  A game warden, sheriff or other peace officer who issues a 28 
warning citation pursuant to subsection 1 shall report the name and 29 
address of the person to whom such warning was issued to the 30 
Tahoe Regional Planning Agency. 31 
 3.  An agency that provides law enforcement or other public 32 
safety services is not subject to the provisions of section [54.16(A), 33 
54.16(B)] 60.1.3(E) or [81.2(E)] 84.10 of the Code of Ordinances 34 
adopted by the Tahoe Regional Planning Agency and in effect on 35 
[April 1, 1999,] August 25, 2024, when performing its official 36 
duties during an emergency or disaster on the waters of Lake Tahoe 37 
if such duties are performed in an effort to protect life or property. 38 
 4.  As used in this section: 39 
 (a) “Region” has the meaning ascribed to it in NRS 277.200. 40

limits of this state. 2 
 Sec. 3.  This act becomes effective upon passage and approval. 3
