AN ACT relating to cannabis; authorizing an agent of the Cannabis Compliance Board to issue a hold order for cannabis or a cannabis product only under certain circumstances; requiring the Board to adopt regulations governing hold orders; revising requirements concerning the amount of usable cannabis, THC and concentrated cannabis that may be contained in a single package; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law provides for the licensure and regulation of persons and 1 establishments in the cannabis industry in this State by the Cannabis Compliance 2 Board. (Title 56 of NRS) Section 1 of this bill authorizes an agent of the Board to 3 issue a hold order for cannabis or a cannabis product to prohibit a person from 4 transferring, moving or disturbing the cannabis or cannabis product without the 5 approval of the Board or an agent of the Board only in accordance with regulations 6 adopted by the Board. Section 1 requires the Board to adopt such regulations 7 governing hold orders and sets forth certain requirements for the content of those 8 regulations. 9 Existing law requires an adult-use cannabis product to be sold in a single 10 package. (NRS 678D.420) Section 2 of this bill revises requirements concerning 11 the amount of usable cannabis, THC and concentrated cannabis that a single 12 package may contain. 13 – 2 – - *SB168* THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 678A of NRS is hereby amended by 1 adding thereto a new section to read as follows: 2 1. An agent of the Board may issue a hold order for cannabis 3 or a cannabis product to prohibit a person from transferring, 4 moving or disturbing the cannabis or cannabis product subject to 5 the order without the approval of the Board or an agent of the 6 Board only in accordance with the regulations adopted by the 7 Board pursuant to this section. 8 2. The Board shall adopt regulations setting forth procedures 9 and requirements for the issuance of a hold order for cannabis or 10 a cannabis product. The regulations must: 11 (a) Authorize an agent of the Board to issue a hold order only 12 under circumstances in which cannabis or a cannabis product 13 fails to satisfy a requirement set forth in this title or the 14 regulations adopted pursuant thereto and constitutes a substantial 15 hazard to the public health. 16 (b) Require that at the time of issuance of a hold order notice 17 be provided to the cannabis establishment whose cannabis or 18 cannabis product is subject to the hold order stating the reasons 19 for the hold order. 20 (c) Require a hold order to be automatically terminated not 21 later than 14 days after its issuance unless the Board, after notice 22 and a hearing and for good cause shown, extends the duration of 23 the hold order. 24 (d) Set forth the circumstances under which a hold order may 25 be terminated. Such circumstances must include, without 26 limitation, for cannabis or a cannabis product subject to a hold 27 order because of the failure of any test conducted by a cannabis 28 independent testing laboratory, the passing of that test upon 29 retesting of the cannabis or cannabis product. 30 3. A person shall not transfer, move or disturb any cannabis 31 or cannabis product for which a hold order has been issued 32 pursuant to the regulations adopted pursuant to this section 33 without the approval of the Board or an agent of the Board. 34 Sec. 2. NRS 678D.420 is hereby amended to read as follows: 35 678D.420 1. An adult-use edible cannabis product or an 36 adult-use cannabis-infused product must be labeled in a manner 37 which indicates the number of servings of THC in the product, 38 measured in servings of a maximum of 10 milligrams per serving. 39 2. An adult-use cannabis product must be sold in a single 40 package. A single package must not contain: 41 – 3 – - *SB168* (a) More than [1 ounce] 2.5 ounces of usable cannabis or [one-1 eighth of an ounce] 3,500 milligrams of concentrated cannabis. 2 (b) For an adult-use cannabis product sold as a capsule, more 3 than 100 milligrams of THC per capsule or more than [800] 1,000 4 milligrams of THC per package. 5 (c) For an adult-use cannabis product sold as a tincture, more 6 than [800] 1,000 milligrams of THC. 7 (d) For an adult-use edible cannabis product, more than 100 8 milligrams of THC. 9 (e) For an adult-use cannabis product sold as a topical product, a 10 concentration of more than 6 percent THC or more than [800] 2,500 11 milligrams of THC per package. 12 (f) For an adult-use cannabis product sold as a suppository or 13 transdermal patch, more than 100 milligrams of THC per 14 suppository or transdermal patch or more than [800] 1,000 15 milligrams of THC per package. 16 (g) For any other adult-use cannabis product, more than [800] 17 1,000 milligrams of THC. 18 3. To the extent that they are inconsistent or otherwise conflict 19 with the regulations adopted by the Board pursuant to NRS 20 678D.480, the requirements of this section do not apply to a ready-21 to-consume cannabis product prepared and sold by a cannabis 22 consumption lounge. 23 H
