AN ACT relating to discrimination; revising provisions relating to certain investigations conducted by the Nevada Equal Rights Commission; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law prohibits various practices of discrimination based upon race, 1 religious creed, color, age, sex, disability, sexual orientation, gender identity or 2 expression, national origin or ancestry. (See, e.g., NRS 118.100, 613.330, 651.070) 3 Existing law also authorizes the Nevada Equal Rights Commission to investigate 4 tensions, practices of discrimination and acts of prejudice against any person or 5 group based on race, color, creed, sex, age, disability, gender identity or expression, 6 national origin or ancestry. (NRS 233.150) This bill requires the Commission, 7 when conducting an investigation into an alleged unlawful discriminatory practice 8 in housing, employment or public accommodations, to consider whether the 9 practice was motivated by antisemitism. This bill also defines the term 10 “antisemitism” for the purpose of this requirement. 11 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 233 of NRS is hereby amended by adding 1 thereto a new section to read as follows: 2 1. When conducting an investigation into an alleged 3 unlawful discriminatory practice in housing, employment or 4 public accommodations, the Commission shall, for the purpose of 5 determining whether the alleged unlawful discriminatory practice 6 was based on the religious creed of a person or group, consider 7 – 2 – - *SB179* whether the alleged unlawful discriminatory practice was 1 motivated by antisemitism. 2 2. As used in this section, “antisemitism” means a perception 3 of Jewish people which may be expressed as hatred toward Jewish 4 people. The term includes, without limitation, rhetorical and 5 physical manifestations of antisemitism directed toward: 6 (a) A Jewish person or non-Jewish person; 7 (b) A Jewish community center, synagogue or other place of 8 religious worship; or 9 (c) The property of a Jewish person or non-Jewish person. 10 H
