AN ACT relating to voter registration; requiring each county clerk to use, or contract with a person authorized by the United States Postal Service to use, the data compiled by the United States Postal Service concerning changes of address of its postal patrons to correct certain portions of the statewide voter registration list; requiring the county clerk to publish on the Internet website of the county clerk the number of persons removed from the statewide voter registration list using such data; and providing other matters properly relating thereto. Legislative Counsel’s Digest: Existing law authorizes county clerks to use any reliable and reasonable means 1 available to correct the portions of the statewide voter registration list which are 2 relevant to the county clerk and to determine whether a registered voter’s current 3 residence is other than that indicated on the voter’s application to register to vote. 4 (NRS 293.530) Existing law further sets forth various methods for a county clerk to 5 maintain and update the statewide voter registration list, including authorization for 6 the county clerk in each county to enter into an agreement with the United States 7 Postal Service or any person authorized by it to obtain the data compiled by the 8 United States Postal Service concerning changes of addresses of its postal patrons 9 – 2 – - *SB205* for use by the county clerk to correct the portions of the statewide voter registration 10 list which are relevant to the county clerk. (NRS 293.530, 293.5303, 293.5307) 11 Section 1 of this bill requires rather than authorizes the county clerk of each county 12 to use, or contract with any person authorized by the United States Postal Service to 13 use, the data compiled by the United States Postal Service concerning changes of 14 addresses of its postal patrons to correct the portions of the statewide voter 15 registration list relevant to the county clerk. Section 2 of this bill makes a 16 conforming change to reflect the requirements imposed on the county clerk by 17 section 1. 18 Section 1 additionally requires a county clerk to publish on the Internet website 19 of the county clerk the number of persons removed from the statewide voter 20 registration list using such data. 21 THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. NRS 293.5303 is hereby amended to read as 1 follows: 2 293.5303 1. In addition to the methods described in NRS 3 293.530, the county clerk in each county [may enter into an 4 agreement with the United States Postal Service] shall use, or 5 contract with any person authorized by [it] the United States Postal 6 Service to [obtain] use, the data compiled by the United States 7 Postal Service concerning changes of addresses of its postal patrons 8 [for use by the county clerk] to correct the portions of the statewide 9 voter registration list relevant to the county clerk. 10 2. The county clerk shall publish on the Internet website of 11 the county clerk the number of persons removed from the 12 statewide voter registration list pursuant to this section. 13 Sec. 2. NRS 293.5307 is hereby amended to read as follows: 14 293.5307 [If a county clerk enters into an agreement pursuant 15 to NRS 293.5303, the] A county clerk shall review each notice of a 16 change of address filed with the United States Postal Service by a 17 resident of the county and which is obtained by the county clerk 18 pursuant to NRS 293.5303 and identify each resident who is a 19 registered voter and has moved to a new address. Before removing 20 or correcting information in the statewide voter registration list, the 21 county clerk shall mail a notice to each such registered voter and 22 follow the procedures set forth in NRS 293.530. 23 Sec. 3. The provisions of NRS 354.599 do not apply to any 24 additional expenses of a local government that are related to the 25 provisions of this act. 26 Sec. 4. 1. This section and section 3 of this act become 27 effective upon passage and approval. 28 2.
