AN ACT relating to local governments; authorizing a board of 
county commissioners and a governing body of an 
incorporated city to, with certain exceptions, enact an 
ordinance or measure relating to affordable housing; and 
providing other matters properly relating thereto. 
Legislative Counsel’s Digest: 
 Existing law authorizes a board of county commissioners or a governing body 1 
of an incorporated city, with certain exceptions, to exercise all powers necessary or 2 
proper to address matters of local concern for the effective operation of county or 3 
city government, as applicable, whether or not the powers are expressly granted to 4 
the board or governing body. (NRS 244.146, 268.0035) This bill authorizes a board 5 
of county commissioners and a governing body of an incorporated city, except as 6 
expressly prohibited by statute, to enact any ordinance or measure relating to 7 
affordable housing. 8 
 
 
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN 
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 
 
 Section 1.  Chapter 244 of NRS is hereby amended by adding 1 
thereto a new section to read as follows: 2 
 Except as expressly prohibited by statute, a board of county 3 
commissioners may enact any ordinance or measure relating to 4 
affordable housing. 5

 Sec. 2.  Chapter 268 of NRS is hereby amended by adding 1 
thereto a new section to read as follows: 2 
 Except as expressly prohibited by statute, the governing body of 3 
an incorporated city may enact any ordinance or measure relating 4 
to affordable housing. 5 
 Sec. 3.  This act becomes effective on July 1, 2025. 6
